Good Morning from the Zundelsite:

Today, I have sad news to report. Ernst Zundel was arrested yesterday, allegedly on an immigration violations matter. In a nutshell, he was told that he had missed showing up at a scheduled immigration hearing in May of 2001. Things are still very sketchy, but I will tell you what I know and, in essence, documented for Ernst's immigration attorney:

This is what I remember about Ernst's arrest by the officers of INS:

It is now 1:10 pm.

Shortly after 11 a. m. the door bell rang. I was in my office. I remember the time because I am on a diet and I knew I could have a snack at 11 a.m. Ernst and John, a local man who helps out with odd jobs, were working on Ernst's painting, framing some of them.

Two minutes or so later, Ernst came into my office and said, as I remember it. "Guess what. The INS guys are here because I am supposed to have missed a hearing."

I went outside with him, and there were a total of 5 men, one of them in uniform. (John later told me that the man in uniform was the local deputy sheriff.) Ernst stood by the hood of John's car with one of the officers handing him a pad with a one-page text that he was trying to get Ernst to sign.

Ernst asked if he could call his lawyer. He was told that he could not.

I asked if I could call a lawyer, and I was told that I could not.

The demeanor of the men, I felt, was threatening. Ernst said he wanted to read the document he was to sign, and was told the men did not have all day. Nonetheless, he read it very carefully, then told them that he never received a request for a hearing. I reiterated that as well. I also said that we had received a notification that said a hearing might take "up to 36 months". (Ernst had applied for permanent residency status in the US in the summer of 2000) The officer just shrugged. Ernst was again urged to sign the paper, and I suggested that he put a note at the bottom stating that he had never received a hearing date. Ernst then said, as I remember it: "What happens if I don't sign it?" and he was told by the man who stood to his left: "Then we'll have to arrest you." "And if I sign it?" At that, the man said: "Either way. We are here to arrest you."

Thereupon Ernst signed the paper, I believe. Maybe he just wrote his objection. I never saw what was written there, nor was I given a copy. Ernst then asked me to get him a jacket and his passport. I went upstairs and one of the agents followed me. He was very snoopy and looked around in several rooms but did not touch anything. He only said: "You have a nice house. You have a lot of books. Your husband likes to read?" I said: "We both like to read."

I found the jacket and passport, and when I came down, Ernst had emptied his pockets of his bills and money. It lay on the hood of John's car. He said to me: "Remember what I told you? That's what they were going to do. Use a bureaucratic excuse to get me." (That was the meaning of his words. I don't remember them exactly.)

I had the presence of mind to ask the names of the officers. They are: John Barnes, Gary Slaybough (apparently the boss), Scott Pitman, Sat D. (?) Lee, and County Sheriff Steve Watson.

Ernst then said to the officers: "I am on medication. Can I take my medication along?" He was told that he could. He asked me to get it, and I went upstairs to get it. Again, one of the agents followed me. I was shaking by that time, but I got his medication in a plastic grocery bag and took it down. I saw that he was being put in handcuffs. I said, thinking of his sore wrist: "Is that necessary? There's five of you. He isn't going to run away." One of the officers said: "We do that to all of them, not to show favoritism." Then Ernst was led away.

I did not see in which car he was put, or if he waved goodbye. It all happened very fast.

Our helper, John, was there the whole time because he had worked with Ernst on his painting frames in the garage, and he witnessed everything. I went upstairs, found our immigration lawyer's number, and called him. I told John to stay with me and listen so I would have a witness.

The immigration lawyer said he knew nothing of a hearing; he had not been informed either. He also said that people didn't get arrested for missing a hearing. He said he would call around and find out what was going on. I told him that one of the officers had told me that Ernst was being taken to Knoxville, and that I would be called and informed what would happen to him. (So far, I have not yet been called by any of the agents.) The lawyer repeated that he would call around to find out what was going on and he would call me back.

I then called another attorney who is a family friend who had been with us when we first met the immigration lawyer. This attorney thought that the arrest probably had to do with "war fever" - that immigration was rounding up people and Ernst's enemies took advantage of the situation and put on pressure in the right places. He also thought there might come the question of bail, and that bail for a federal arrest was very high. I said that we would not be able to pay it.

Our friend then offered to have his in-laws come and stay with me for a few days. I told them I had trusted friends in the area and would be all right.

I then talked briefly with John and asked for his recollection. John told me that he was asked for ID and some nosy questions, and he also said he perceived the agents as threatening.

I told him that chances were he would be interrogated, and to make sure to tell the truth. I told him that I was sure he knew that Ernst had a high profile, but that he also knew we were decent people who had nothing to hide. I told him it was very important to tell the truth is he knew it.

Our lawyer friend then called me back and said that he had had a very good conversation with the immigration lawyer who thought that a judge had not ordered the arrest, that the arrest came from the Immigration Commissioner - that is, from the top.

John is upstairs writing down what he saw and experienced.

I only want to add that I have since talked to Ernst twice, last night and this morning. He is being held in a neighboring county jail and expects to be sent "elsewhere". He also said to look in the drawer of his night stand for my Valentine's present.

How do I feel? I feel like I felt as a child when my father was taken away by Soviet goons, under a similar flimsy pretense and without any prior notification. My readers know that I never saw my father again.

I expect to see Ernst again - make no mistake about that!

No question in my mind that the Jews who run my country are now reaping the benefits that only a 9/11 could have provided them: the pretext for an extralegal full-steam-ahead against any and everyone who sees them as they are under their masks.

Good Morning from the Zundelsite:

I have been deluged with interview requests from major media, all of which I turned down with relish. Let them all stew a bit! The Internet is where it's at - and we have barely started!

To say that the Net is ablaze once again with the Zundel struggle is probably an understatement. One ZGram reader wrote: "I am amazed at how much discussion is going on {in the newsgroups} over this. Great to see."

To which I replied:

"I think that this is yet another stepping stone toward historical truth. Ernst is a big, big hero on the world stage! Certainly more admired and loved at this time than his enemies are! You may quote me on that, if you like!"

I will keep you informed about developments to the extent that I can. Meanwhile, here is a smorgasbord of reader letters - all of them from people on OUR side, with the exception of the last one: the ONLY nasty letter I have, so far, received!

For how long have I said, "There's more of US than THEM"? That ought to be a bumper sticker slogan, don't you think?

My friends around the world, take heart! This is another painful blow. We are, however, going to fight this round like any other round. With honor! Courage! And conviction that we are right and have the truth on our side, while all "they" have is lies.

I'll do my part. You know that you can help and will be asked to help.

I was very distressed to hear the news, and no doubt there are political machinations at work. This is incontrovertible confirmation that our bureaucracy serves another master, as if we needed more evidence... From what I know, an arrest for this de minimus violation, EVEN IF TRUE, does not merit this response, in and of itself. This is the most horrible news I've read. If the government gets away with this, there's no limit to far they will go to squelch any opposition to their plans for world domination. I'm ashamed that we, as a country, have let our government get so out of control, and so far from being representative of the people. It is a pity that you could not have walked out with a digital camera and got a quick photo of all of the participants and that document. I hope that this is merely a routine matter--but I tend to agree with the immigration lawyer: this is some deal to placate the scum in Canada, who doubtless have plans to hand Ernst back to the scum in the Bundesrepublik.

My advice would be to attempt to make maximum publicity out of this--including attempting to enlist civil liberties types. It's a cause all revisionists can and should rally around. When They Come.

 Almost everything "NWO" is in place for the final steps toward

complete control of the world's only remaining superpower. As they say in the construction trade, all that's left is "Punch Out". the tying off of loose ends. There is now a one party system with no checks or balances, a party that has demonstrated since assuming even partial power two years ago, to be capable of anything, believing and demonstrating that they are above the law. With full power stolen on Nov. 5, 2002 we now have the patients running the asylum.

 Supreme Court Jester  "William H. Renquist"  said "In times of

war, the courts are silent", That Supreme Court message is loud and clear, the Supreme Court is ready, willing and waiting to do the bidding of the "NWO" when the time comes. "Law" will be just another three letter word.

 I am convinced as are many, that there will be an accelerated

power grab unprecedented in American history. The "NWO" will orchestrate yet another major terrorist attack, and led by Bush with the aid of Ashcroft will suspend habeas corpus, Martial Law will be declared, the people will be asked to "temporarily" give up the remainder of their rights and freedoms, once again for patriotism and National Security. The now dormant internment camps will be re- activated and the "unpatriotic" will disappear unannounced. The cries of the loved ones will go unheard..

 We know the next attack is coming. Bush, Rumsfeld, Ridge, the

FBI and the CIA have already told us this daily. Every day, every night the "Propaganda Matrix" tells us to be alert, another attack is imminent, the threats are constant. When will it happen? We're not sure. Where will it happen? We're not sure. What will happen? We're not sure. But happen it will, it must, it is the agenda, we have been warned. The hunter has alerted the hunted.

 Who will stop the suspension/elimination of all future

elections?

 Who will stop the immediate though temporary "National Curfew"?

 Who will stop the immediate and mandatory

registration/documentation of American citizens?

 Who will stop the "Internment Roundup"?

their own set of checks and balances out of a feeling of honor or guilt, out of what is right or wrong? Of course not! The "One Party System" was created by the "NWO" to eliminate checks and balances in order to further the agenda. Honor, guilt, right or wrong have no meaning.

 Will it be members of the new "One Party System" doing the job

they were elected to do, to represent the people? Of course not! The new "One Party System" is an extension of the old "Two Party Smoke and Mirrors System" of constituent representation. This has already been displayed by their support of a war with Iraq. In ignoring the voice of the majority in opposition, for the voice of the few with the most money, power and the most to gain, they have decided personal gain outweighs constituent pain and anger. Or the announcement of a special "Shadow Government ("NWO") Bunker" to protect only those selected by the power grabbers in the event of another staged attack. Those not in the know....blow! No they will not help you!

 Will it be the Conservative Press? Of course not&#33; These outlets

are bought and paid for members of the "Propaganda Matrix" They are owned and operated in whole by just 10 members of the "Friends and Supporters of the "NWO". The ownership of all that you see and hear by just 10 hand picked friends of the party has been years in the making. Their job is only to make the news you are allowed to hear, anything else would be "unpatriotic", not to mention that there would be an immediate call for an immediate merger by the "NWO" of two or more thus limiting the number of owners sharing the financial pie. No, not them either.

 Will it be the people themselves, An outcry from the oppressed?

Of course not! The majority of them are the programmed, the believers of the attack, the threatened. They've been programmed and programmed well to require/need the protection of the "NWO". Most will except this total control of their lives as their "Lot In Life" the Christians will except it as God's will! The attackers hate us for our freedoms (remember that little gem of wisdom from the un-elected one?) So it stands to reason that our freedoms must be taken away for the good of our nation and it's people. No, helping themselves would not enter the thought process. Resistance has been programmed to be futile!

 Perhaps you&#39;re thinking it might be one or more of the militia

out there, their armed, they have guns, they could help? Wrong! True some may try, some may even attempt a counterstrike and take a few with them, but chances are even money that the majority of militia members are also registered members of the NRA, registered meaning that the NRA has a list of all members and their families with pertinent, personal information on each and every one of them. Information that will aid the disarmament of these possible threats to our National Security. The fight for protection of the second amendment and open support of the NRA by "The Rabid Right" has enabled a data base to be constructed for the soul purpose of knowing who to disarm first. No the militia will be part of the first wave to be Waco'd if need be. A good portion may actually join the movement as patriotic, loyal volunteers helping to disarm their brethren. No help here!

 So who&#39;s left?......Let&#39;s see......Ah yes&#33; The resistors, the little known,

but growing minority of people out there that see through the smoke and mirrors, the ones that refuse to be programmed, the ungoverned and ungovernable. The growing number that refuse to believe the unsubstantiated rumors disguised as truth by the "Propaganda Matrix", refuse to believe the "He said-she said" accusations without basis. The highly visible and highly vocal protestors of wrong in any form, that gather in number to voice dissent.

 The programmed response of the masses would suggest that these

visible/vocal dissidents would and should be the first to be "interned", after all, dissent and resistance during the threat of war and attack is unpatriotic and treasonous.....Isn't it? This is the call that has already been made, this is the call that will increase as the need to control progresses further.

 Yes, some will indeed be interned, not to be seen or heard from

again, these will be the few caught by surprise, unaware of the urgent acceleration at hand. The remembered.

 Others, smart, aware, and determined, will avoid internment, will

escape into the night, scattered into small groups.....waiting, their resistance efforts temporarily suppressed....waiting, their actions temporarily made inactive....waiting, their voices temporarily quieted.... waiting, their numbers temporarily depleted....waiting Will it be these few that will heed the call once again to resist as before? Of course not! ........Not until the time is right and the waiting is over.

I am sorry I could not get anything out to my readers yesterday and only now at least some partial information. I am walking around the house with three telephones hanging from my belt! The calls are simply non-stop!

I am encountering resistance at every government level. I was trying to find out who gave the order for Ernst's arrest and have not been able to get a reply. I am working on it, and just as soon as I have contact numbers, I'll send them to you to put some heat where it belongs.

Meanwhile, please familiarize yourself with both the content and the sequence of what happened - so that, when I send you names and addresses to contact, you can respond in an informed and responsible way.

We are working on several strategies. I was told this morning by a very nasty person in the Memphis INS office that Ernst will be deported just as soon as they can manage.

Therefore, publicity about this case NOW is CRUCIAL!

You'll say: But where? Start on your own. Call your own representative. Ask what happened to freedom of speech. Call the ACLU.

Ask why the borders, both north and south, remain porous letting in millions of undocumented foreigners, while someone like Ernst ZÃÂ¼ndel, living quietly and peacefully, gets harassed. Be creative. And just as soon as I find out, I will send you contact names and numbers.

The most urgent questions to be asked are:

Who ordered this arrest? Who signed the deportation order?
Is it customary to arrest a person on an alleged minor immigration violation by five (!) agents?
What are the procedures to prevent deportation to Germany where Ernst would be convicted and imprisoned? What are the steps? Who should we contact?
What happened to the First Amendment guarantee? Are people in America still free to speak their conscience?

Ernst Zundel is a globally known activist speaking on behalf of the maligned and vilified World War II German generation, insisting on fairness and historical truth. His enemies like to call him names - a mild one being "Holocaust denier."

Ernst has battled the Holocaust Lobby for decades and is the man responsible for the "Leuchter Report" - a scientific report based on a forensic investigation of Auschwitz that puts an end to the claim that "...the Germans gassed six million Jews."

Ernst has very powerful and nasty enemies. He has survived three documented assassination attempts - a paid-for arson (1995) and two parcel bombs (1984 and 1995). He is a lifelong pacifist who scrupulously obeys the law.

Ernst is a German national who lived in Canada for 42 years. He applied for citizenship twice, and was twice denied. He was not given any reason. This means that he is still a German citizen.

In Germany, "Holocaust Denial" is against the law. You can get up to five years in prison for "... defaming the memory of the dead." Many people are in prison for "holocaust denial" and thousands have been prosecuted. This is a vicious law in Germany that prevents people from presenting the facts or even speaking of facts as they know them and have checked them out.

I know that this latest arrest is meant to deport Ernst to Germany on a technicality where he will be charged, sentenced and imprisoned without being allowed a defense - even witnesses and attorneys are charged and punished for aiding a defendant charged with "Holocaust denial".

Once Ernst is convicted and imprisoned, somebody will make sure the key is thrown away.

I fear that even worse could happen and that his very life will be in jeopardy.

I am a naturalized US citizen of German background. I met Ernst in 1994 and we married in January of 2000. We purchased a home in Tennessee and have lived here quietly since the summer of 2000, trying to build a new life for ourselves.

After we married, we applied for permanent resident status for Ernst. From the beginning, we engaged a reputable, knowledgeable immigration attorney who carefully followed procedures. Given my husband's high profile, it was and is in our interest to cooperate in any way we can.

We have lived at the same address for more than two years. We are listed in the telephone book. My husband has an American Social Security Number, a Tennessee driver's licence, and a work permit. He has been vaccinated and fingerprinted, as requested by INS.

We were told that the next step would be a personal hearing before an immigration judge, but that this could take as long as 36 months.

In May of 2001, we received a request for an immigration hearing. Our attorney could not make it, and he requested a re-scheduling. A copy of this request exists. It is dated May 23, 2001.

Our attorney wrote to INS:

"I am in receipt of your appointment letter for the interview concerning the application for Adjustment of Status of Mr. Zundel. Unfortunately, I will not be able to attend this service and am requesting that it be rescheduled...my schedule conflict(s) and I am respectfully requesting rescheduling of this appointment."

There was no reply from INS.

Our attorney wrote again on May 6, 2002, one year later, this time sending the letter certified. I have a copy of this letter and a copy the return receipt; the original is kept at our attorney's office.

This time, our lawyer wrote:

"Please be so kind as to reschedule the interview that was cancelled last year on June 12, 2001. It has been quite some time and surely this matter can be advanced for personal interview."

Again, there was no reply from INS.

My husband and I were not overly concerned, since we had been told that procedures could take as long as 36 months. We simply awaited instructions.

Last Wednesday, 5 INS agents showed up and bullied Ernst to sign a document that stated he agreed to be deported. I only found out later what kind of document it was. It was a deportation order, "...signed and sealed and unappealable."

Ernst asked what would happen if he did not sign this document.

He was told: "Then we'll arrest you."

"And if I sign the document?"

The answer was: "Either way. We are here to arrest you."

I stood next to him. I don't know if he signed this paper or if he just noted that he was under duress and protested the manner in which this violation of his rights as a man married for three years to a US citizen was handled.

The agents asked him to empty his pockets and lean against a truck to be frisked, as though he were a common criminal. Next they put handcuffs on him and took him away.

Media reports now tell me that he was arrested because he "overstayed his visa."

I was not given any copies of any documents or justification for this arrest. No one from either the INS or the local sheriff's office has called me as of 9:00 a.m. this morning, Feb. 11, and told me what will happen next. I feel that what happened to my husband was akin to a kidnapping with the assistance of the law.

With much difficulty and many runarounds I finally found out that Ernst is being held in the detention facility in Blount county, a jail that is located about an hour from where I live. Ernst has since been able to call me once a day. No one has contacted him or told him what would happen next, not even his attorney. I must assume that roadblocks are being put in his way.

I was allowed to see Ernst once, last Saturday, after unbelievable obstacles and many unnecessary bureaucratic hassles. I believe that my husband is being given the "Diesel Treatment" within the prison facility itself whereby he is moved from unit to unit so that his visiting hours get cancelled, postponed or mixed up in administrative procedures.

I don't know what will happen next. A spokesperson in the Louisiana Regional INS office - I believe her name is spelled "Maow" - told reporters that, "in layman's terms, that Ernst Zundel is out of legal immigration status", that he might get a hearing before a judge "if it is appropriate", and that "he could be removed without going to a judge."

That is an ominous statement!

Because of my husband's high political profile and the enormous power of the Holocaust Lobby in America, I fear that his enemies plan to whisk him out of the country to Germany just as fast as they can.

If they succeed, a conviction for "Holocaust denial" in Germany is a foregone conclusion.

What does that mean? Not only would he get 5 years in jail, he would be prevented from returning to America for ten years because he would have a "criminal" record for Holocaust denial!

The Zundel case is - to me - the acid test for VDARE. There are any number of OD'ers who swear by VDARE as the 'effective, moderate, non-extreme' voice of Racial Sanity that America will listen to and absorb (as opposed to the more scorched-earth WN-type viewpoints).....while some of us see VDARE's "reasonableness" as their sole reason for being. I.e., railing at Mexicans is easy: none of the letters in AIPAC stand for "Mexico", you see, while "V Dare" itself is ostensibly named after the first white child born in the New World.

With all of their outrage over racial trends and coming-demographics-of-doom caused by massive nonwhite immigration, they are supposed to also be an advocate for the beleaguered (fast-vanishing and utterly voiceless) white European immigrant to the US. If an Ernst Zundel - here legally, committing no crime nor affixing himself parasitically to the public sector - can be baited into a technicality and expelled back to Europe and an almost-certain jail cell (for Thought Crimes) while ten million mestizo mouth-breathers turn the Southwest into a no-go zone for whites....and Peter Brimelow remains silent, or hides behind blanket anti-immigration rhetoric, or in any way feigns a sudden hearing problem on this story....then VDARE is a front whose fear of Jews is a thousand times realer & more substantial than any pose of anger (towards anyone or anything else) they care to strike.

One other possible VDARE wrinkle intrigues me, and that is its potential co-option by Jews. Part of this is Pandora's Box blowback: as the teeming post-65 Swarm yields up more and more Arabs who commandeer jets and blow things up and poison people there is a certain inevitability to a Jewish flip-flop on the immigration issue. [Add to that the increasing Semitical awareness of the Aztlan crowd - and their forthright editorials in La Voz saying so - and you get the feeling Hymie is about to find yet another outward husk to be utterly sucked dry of value & camouflage, and put on his Reinvention shoes.]

Frankly, I see it happening already. The average American reading VDARE the past few months can't help but come away thinking of it as a focus group on illegal Mexican immigration (granted, it's a real problem). What they've moved farther and farther away from is a reaffirmation that America and Western Europe are white homelands, built by and for whites, that our race and bloodlines represent the jewel in the crown of human civilization - and that not only is there no shame in this fact, it IS a fact and not an 'interpretation' of history no more or less valid than one claiming "blacks built this country, Whitey just lives in it" or "we have always been a gorgeous mosaic of many cultures". VDARE used to be pro-white and anti-third world immigration. That it has toned down the first part to focus entirely on thesecond is the kind of recalibration that Jews would demand as a prerequisite before taking over.

And if the Tribe does go anti-immigration, make book on their quickly dominating the Officially Sanctioned Venues of such positions. They'll do whatever it takes to fracture whatever established order & unity existed prior to their arrival and before you know it they'll be infesting mastheads like kudzu. (It'll come in handy later, too - helping to minimize the inconvenient facts of Who Led Us Here in the first place, and to invalidate dissenting/questioning voices.)

Black said no hearing is necessary. Zundel came into the United States under the visa waiver program and has outstayed his term, he said.

Zundel had lived in Canada for 38 years. There he published books and other materials denying the Holocaust ever took place and supporting Hitler's views. He has been called "Canada's most infamous Holocaust revisionist." He is not a citizen of Canada. He tried to become one, but his bid was finally rejected Dec. 14, 2000.

By that time he had moved to Wears Valley with his third wife, Ingrid Rimland Zundel. In January 2002 the Canadian Human Rights Tribunal ruled that his Web site was unlawful because it contains hate messages against Jews.

Temple said the INS is awaiting documents from Germany before Zundel can be deported; they could take two days or a week to arrive, he said. He said a lawyer could intervene on Zundel's behalf. That is what Ingrid Zundel is trying to arrange.

"We have a lawyer in Memphis," she said in a phone interview, but her husband needs an immigration lawyer closer to home. So far she has failed to find one. "It's very frustrating," she said.

Denying the Holocaust took place is a crime in Germany punishable by a jail sentence of up to five years, Ingrid Zundel said. Her husband left Germany for Canada when he was 19.

She said they came to the area because they have a friend near Asheville. They were looking for "a nice, quiet, decent place" where the media would leave them alone. They fell in love with the house, and Wears Valley is "so beautiful," she said. It reminds Ernst Zundel of the Black Forest where he grew up. "We love it here," she said.

"We are here legally... We are not hiding. We are not doing anything wrong," she said. Her husband has a work permit, a Social Security number and driver's license; "we just happen to be politically incorrect," she said.

Now he is in jail "with criminals and crazies," he said. "It is beyond belief."

"...We are decent people. We don't need to be taken away in handcuffs like wetbacks coming across the border," she said.

Her husband "is one of the sweetest people on earth but he has strong political views."

Since Zundel's arrest Wednesday, "it seems like the entire world wants to know what happened," she said. Despite "very nasty" stories in the media, "I have not received a single harassment call in this community. This is a peaceful, wonderful community."

She said she will talk to local media because "I want to be treated decently. I have to live in this town."

He's bluffing shamelessly. There are enough irregularities in INS' particular procedure in this case for a good immigration-law attorney to drive a truck through.

What I'mwondering is how this can stand up whren the INS is a federal agency who have done less than nothing to deport millionsof outright-illegals or fail to keep those deported from returning. I'm wondering how it is that Chicago can hand out ILLEGAL ALIEN: DO NOT DEPORT cards that parasite-infested mestizos can present for access to free medical care, or even during arrest, and Zundel gets gagged and trussed and slipped aboard a midnight boat to Germany without half-a-dozen crack lawyers salivating at the chance to depants the government in court pro bono here.

But these are extralegal times we're living in. Given J E Dubya's favorite new toy is targeted assassinations of potential terrorists - and since terrorism always begins with thoughts spoken aloud and words on paper, after all - maybe Ernst is lucky he's only being shanghaied.

If there are any Germans left with a vestige of self-respect and identity left in that sad, abused country - if there are Germans who will see in Zundel a living symbol of what the Jews have done to a proud people, and feel some dying ember in them spark suddenly to life - Ernst Zundel will get a hero's welcome. At the very least, they ought to acknowledge that the Arabs who "hate us for our freedom" aren't the ones deporting white men who exercise that freedom.

The uneasy relationship between German-born Holocaust denier Ernst Zundel and his adopted home of Canada may be only days away from resuming.

As Mr. Zundel sat in a Tennessee jail cell awaiting deportation Thursday, a U.S. immigration spokesman said that the prisoner will now likely be sent back to Canada Ã¢â¬â and not Germany, as previously stated.

"I got bad information," said Temple Black of the U.S. Immigration and Naturalization Service in New Orleans. "It looks like this guy is going to be going back to Canada rather than Germany."

Saying that the U.S. has been in touch with Canada on the issue, Mr. Black added that "what Canadian authorities will do with him is not known at this time."

An Immigration Canada spokeswoman could not comment on the case Thursday.

Only last year, Mr. Zundel vowed that "I will not set foot in Canada again," Ã¢â¬â an avowal he made because of this country's repeated efforts to strap a muzzle on him while he was a permanent resident.

For the past three years the self-styled freedom-of-expression activist has been living in Tennessee. He was arrested there last week for allegedly overstaying a temporary U.S. visa.

As Mr. Zundel's case descends into immigration-law arcana, his future is not clear.

Mr. Zundel, for example, could try to appeal or delay any U.S. deportation order. Already his wife is asking supporters to call upon the American Civil Liberties Union to intervene.

Currently the INS says that it plans to ship Mr. Zundel back to Canada under the terms of a reciprocal 1987 Canada-U.S. treaty. But some experts say the treaty is not automatic Ã¢â¬â and that it's possible the U.S. could still decide to deport him to Germany, a country with tough antihate laws that Mr. Zundel has ran afoul of before.

Complicating things further is the fact that Mr. Zundel's status in Canada is unclear.

He arrived in Canada in 1958 and became a permanent resident, but his attempts to get Canadian citizenship were not successful.

Because Mr. Zundel has been outside of Canada for a long period, his permanent residency status may be in jeopardy. But this question is muddled by a change in law.

Prior to this past June, it used to be that any permanent residents who stayed outside of Canada for more than six months could have their status stripped by an immigration officer.

New laws, however, set the bar differently: It is only permanent residents who stay outside of Canada for more than three of the past five years whose status is in jeopardy.

Mr. Zundel left Canada for the United States sometime in 2000, making it unclear as to whether he has exceeded the three-year limit.

If he has no status, Canada could attempt to send him back to Germany. But Mr. Zundel would still have access to various appeals and recourses.

Frantic action is an understatement here at Tennessee Zundel_Haus. We have all kinds of legal moves going behind the scenes - as, I am sure, have our enemies. The story is still breaking.

Here is what I have found out so far:

Yesterday, against the greatest of all lawyerly odds, we managed to file a petition for "estraordinary relief" in Federal Court - and did not even get a hearing. A one-sentence judgment by Judge Jarvis: Denied.

Now comes the weekend, and not much will get done. As far as I can tell, this sadistic brutality was planned to have taken place on the sly and handled very quietly, but the Internet saw to it that the story broke - and from there it was media mayhem all the way. Some of my readers thought that I did make a mistake when I restricted my interviews only to alternate media. Let me tell you I was right. Far and away, the media write-ups and broadcasts HAD to get their info from the Zundelsite, and so far it has paid off in advertising millions. For instance, NBC is said to have run it - I am not sure when, but somebody sent me a tape. But I have never EVER seen such fair headline news reporting. As soon as I come up from under, I will transcribe the script. They showed the Zundelsite. They showed some very good titles. They No yammering Holocaust survivor. They even showed the Sinking Auschwitz cartoon. This was prime news. The only "negative" anchor comment was that I had gloated about all the attention I got. This time, at least as far as the media is concerned - they didn't run us. We sat back and forced them to be a bit more polite and civilized. WE controlled what was put on the newscast by forcing them onto the Zundelsite. It was a sweet revenge.

For instance, I refused an interview to the Globe and Mail, taking advantage of the opportunity to lecture the reporter on ethics - or, better, lack thereof, of Canadian media in general! Here is that article:

Deportation to Germany threatens jailed Zundel

Ernst Zundel could face deportation to Germany and that country's powerful antihate laws, after making use of North American civil liberties to deny the Holocaust for more than 20 years.

Mr. Zundel, a German national with permanent-residency status in Canada, had long confounded this country's efforts to shut him up. But on Feb. 5, he was arrested at his Tennessee home by five U.S. immigration agents who came with a deportation order alleging that he overstayed a visa.

A spokesman for the U.S. Immigration and Naturalization Service said yesterday that it appears Mr. Zundel, who is in jail, will be sent to Germany soon.

Temple Black, a New Orleans-based INS spokesman, said that unless Mr. Zundel files a refugee claim or uses some other legal tactic, he could be sent back within "a couple of weeks."

"We have to wait for the paperwork from Germany; that's the way it normally works," Mr. Black said. "And then he'll be deported back to his home country."

Canadian Jewish groups, which had been worried that the United States might try to send Mr. Zundel to Canada, are overjoyed at the prospect that their long-time adversary soon could be in Europe.

Germany has strict criminal laws governing the spread of hate, meaning it would be very difficult for Mr. Zundel, a self-styled freedom-of-expression activist, to spread the message there that he has from North America.

"In Germany, he will be literally out of business. That's something that will make most people breathe a sigh of relief," said Bernie Farber, spokesman for the Canadian Jewish Congress.

During a visit to Munich in 1991, Mr. Zundel was charged with slander, offending the memory of the dead, inciting racial hatred, public incitement and possession of illegal Nazi symbols. He was fined about $30,000, though the amount was reduced to $9,000 on appeal.

In 1996, German Internet-service providers were investigated by the government for providing access to Mr. Zundel's Toronto-based Web site.

Mr. Zundel immigrated to Canada as a teenager in 1958. During the 1980s, he became a familiar and notorious figure.

Reporters would flock to Mr. Zundel's news conferences, where he would complain of persecution by the justice system -- while wearing hardhats or skull caps, or in blackface or strapped to a crucifix. His Toronto home became a library for the like-minded and the site of many protests, arrests and the occasional bombing.

Mr. Zundel twice attempted to obtain Canadian citizenship. In the late 1980s he was convicted of the little-known law against spreading false news, but the decision was overturned by the Supreme Court of Canada.

In the late 1990s, the issue was whether his Toronto Web site disseminated hate. Before losing that battle, Mr. Zundel ceased to defend himself and headed south. "It is perfectly clear to me that the courts of Canada have simply decided that Ernst Zundel has got to go," he said at the time.

About three years ago, he and his wife, Ingrid Rimland Zundel, moved to Sevierville, Tenn., a community of about 12,000 best known as the birthplace of country singer Dolly Parton. Using a Web site, the couple continued to make their views known.

Shortly after moving there, Mr. Zundel said in an interview with The Globe and Mail that he was enjoying the U.S. South. "America, obviously, has a 225-year history of freedom of speech," he said at the time. "I mean, they mean it. None of the things that I've been dragged through the courts for in Canada would have brought me near a courthouse in the United States."

He added: "You have all kinds of intellectual people here in the United States who do and think and write and speak about the topics that I do, and have absolutely no problems with the authorities."

His wife said yesterday that he is "doing okay under the circumstances."

She would not provide the name of his lawyer.

The condition in Blount County jail are inhuman. I received a 12-page, tightly written letter from Ernst describing some of his observations and thoughts, and I am getting brand new insights into the way Ernst Zundel thinks. When things calm down, I have to do our newsletter, and since it is written in English, I will just take the personal comments out and have it translated into languages other than English to be used as the occasion warrants. Those twelve pages are a masterpiece of political thought and what is in store for America in this powder keg right at the brink of war.

This is a very sad story.

The very idea that Mr. Zundel would deliberately break any law is simply preposterous. I've known him for over fifteen years and in all that time, I've never known him to do anything even remotely bordering on illegal.

I've never seen anyone so meticulously law-abiding and fair in his dealings with officialdom, business acquaintances and friends alike.

This is the man who scrupulously weighed his mail and if it was so much as a gram overweight, he would insist on paying the next level of postage. This is the man who always insisted on buying expensive, legally licensed copies of computer software rather than allowing friends to give him free copies on a "burned" CD.

This is the man who promptly paid all parking tickets, even out-of-state or out-of country. This is the man who, in spite of the hectic pressures in his own life, was never too busy to help his friends and neighbors in Toronto and around the world.

If Mr. Zundel says he was unaware of any hearing date that he missed, you can bet your bottom dollar that he never received any notification to attend any such hearing.

This gentle man's detention in a jail filled with criminals is an injustice that sullies America The Beautiful.

This writer is right. I have taken calls from many parts of the world, and I have heard grown, even old men weep.

A strange fate has now befallen us. Just as I am finishing this story, our attorney gives me a call. He has heard in Knoxville in a court house from a clerk that Ernst will be deported Sunday. I don't know if it is true. Nobody told me anything. My second one-hour visit since his arrest, I was told, has been re-scheduled for Monday.

Herewith I bid you good-bye on Valentine's Day 2003 - the very day when, 58 years ago, Dresden collapsed into ashes, holocausting hundreds of thousands of Germans, mainly civilians. I once saw statistics somewhere. I may be wrong, but I remember that, in the City of Dresden alone, the victims included tens of thousands of babies under the age 6.

Ernst Zundel was then a youngster then, not yet six years of age. He watched one of the many Allied terror bombings in his vicinity near Pforzheim, a city close to where he lived. These bombing raids targeting civilians were done to force the Germans to their knees.
Robert Lenski in his description of the Second Zundel Trial in 1988, described how Ernst remembers a similar Holocaust, February 23-24, 1945:

". . . which Zundel will never forget, when "golden" Pforzheim was firebombed and consumed by a red cyclone. Though the Zundels' house lay 12 miles distant, the sky above was brilliantly illuminated, and huge neighboring connifers bent toward the city center as if in a gale of wind. The Pforzheim fireball was sucking oxygen toward itself from throughout the surrounding countryside. Zundel, not yet six, watched mystified as millions of leaves and branches were sucked violently skyward, with a howl and a roar."

As the entire world knows by now, "Anne Frank left us a diary" - a manuscript which, incidentally, proved highly questionable as to its authenticy. It was partly written in a ball point pen - a gadget not in general use until 1953.

There were lots of bombing raids in the early and even late spring of 1945 when the war was already technically lost. More than 5000 casualties of the Allied "WÃÂ¼rzburg-Holocaust" were incinerated in one of the last massive bombing raids of World War II. These German victims' wartimes stories are not known. They left no diaries. They perished in the flames of the devastating inferno of March 16, 1945 - among them the following women and children named "Anna":

There was no "infrastructure and industry" in Dresden in 1945...the purpose of the Allied raids was to ensure maximum casualties in order to punish the Germans and force them to capitulate.
"Wetback" was a term coined in the 1950s. Mexican nationals who crossed the border illegally utilized routes that frequently involved crawling through drainage pipes...this caused their backs to literally become wet. Hence, Eisenhower's aptly named "Operation Wetback".

Emergency Update:

Last night, I talked to Ernst briefly. I told him that media had been besieging me again, asking me if it was true that Ernst would be deported shortly. I told them nobody had told me anything. Ernst himself, when I talked to him last, did not know.

Around 5 p.m. or so, one of our attorneys visited him. There were no unusual messages or any indication that deportation or relocation had been scheduled. It is now Monday, 9:40 am.

I was scheduled to see Ernst at 12:45 I called the jail and asked to have my visitor's hour verified. Ernst is no longer there.

The detention center person did not know where he might be.

He said: "Call the INS"

The Knoxville INS does not even give out its number. Besides, it is a holiday today.

I cannot get through to Memphis.

Both of my attorneys are not reachable.

I will give you an update later. Please scan the newspapers, and if you find out anything, please let me know by FAXING, 865-774-7758.

PLEASE DO NOT CALL. I NEED TO KEEP MY PHONE LINES OPEN!

I'll report to you later as soon as I know where Ernst is.

It is a good thing that Ernst and I collaborated so closely together on our newsletters since 1994. Now I know how to put his Power Letter together in an emergency mode - as I have to do today. In the interest of saving time, I summarize the content from my daily ZGrams and then let Ernst speak for himself - out of his cell. Those of you on my ZGram list know all the facts already - I ask your indulgence; I simply don't have the time to do an original letter. Perhaps in calmer times, there will be yet another book in the continuous Zundel saga. In the interest of clarity, the text below has been edited a bit:

ZGram: 2-6-03 Today, I have sad news to report. Ernst Zundel was arrested yesterday. In a nutshell, he was told that he had missed showing up at a scheduled immigration hearing in May of 2001. (!) Things are still very sketchy, but I will tell you what I know and what, in essence, I documented for Ernst's immigration attorney:

It is now 1:10 pm. Shortly after 11 a. m. the door bell rang. I was in my office. I remember the time because I am on a diet and I knew I could have a snack at 11 a.m. Ernst and John, a local man who helps out with odd jobs, were working in our garage on framing Ernst's paintings.

Two minutes or so later, Ernst came into my office and told me: "Guess what. The INS guys are here because I am supposed to have missed a= hearing."

I went outside with him, and there were a total of 5 men, one of them in uniform. (John later told me that the man in uniform was the local deputy sheriff.) Ernst stood by the hood of John's truck with one of the officers handing him a pad with a one-page text that he was trying to get Ernst to sign.

Ernst asked if he could call his lawyer. He was told that he could not. I asked if I could call a lawyer, and I was told that I could not.

The demeanor of the men, I felt, was threatening. Ernst said he wanted to read the document he was to sign, and was told curtly: "We don't have all day!" Nonetheless, he read it very carefully, then told them that he never received a request for a hearing. I reiterated that as well. I also said that we had received a notification that said a hearing might take "up to 36 months". The officer just shrugged. Ernst was again urged to sign the paper, and I suggested that he put a note at the bottom stating that he had not received a hearing date. Ernst then said, as I remember it: "What happens if I don't sign it?" and he was told by the man who stood to his left: "Then we'll have to arrest you." "And if I sign it?" asked Ernst. "Either way. We are here to arrest you!" was the answer.

I never saw what was written there, nor was I given a copy. Ernst then asked me to get him a jacket and his passport. I went upstairs and one of the agents followed me. He was very snoopy and looked around in several rooms but did not touch anything.

I found the jacket and passport, and when I came down, I saw that Ernst had emptied his pockets of his bills and money. The items lay on the hood of John's truck. He said to me: "Remember what I told you? That's what they were going to do. Use a bureaucratic excuse to get me."

Ernst told the officers: "I am on medication. Can I take my medication along?" He asked me to get it, and I went upstairs to get it. Again, one of the agents followed me. I was shaking by that time, but I got his medication in a plastic grocery bag and took it down. I saw that Ernst was being put in handcuffs. I said, thinking of his sore wrist: "Is that necessary? There's five of you. He isn't going to run away." One of the officers said: "We do that to all of them, not to show favoritism." Then Ernst was led away. It all happened very fast.

I went upstairs, found our immigration lawyer's number, and called him. I told John to stay with me and listen so I would have a witness. The immigration lawyer was astonished and said he knew nothing of a hearing; he had not been informed either. He also said that people didn't get arrested for missing a hearing. He said he would call around and find out what was going on.

I then called another attorney who is a family friend and who had been with us when we first met the immigration lawyer. This attorney thought that the arrest probably had to do with "war fever" - that immigration was rounding up people, and Ernst's enemies took advantage of people's hysteria. I then talked briefly with John and asked for his recollection of what we had just witnessed. John told me that he was asked for ID and some nosy questions, and he also said he perceived the agents as threatening. He told me several had a gun, and one was wearing a bullet-proof vest. I hadn't seen that, but then I was too shaken.

I told John that I was sure he knew that Ernst had a high profile, but that he also knew we were people who had nothing to hide. I told him that, of someone came to question him, it was very important to tell the truth is he knew it. I said we had nothing to hide.

?ZGram: 2-8-03 I visited Ernst today in Blount County Jail where he is being held. Persistence won the day.

Here is what happened:

I had called several times to find out when I could visit, and via many runarounds and yet more runarounds I finally figured out that visiting hours are scheduled according to which floor an "inmate" is assigned. I was first told I could come today, at 11 a.m. When I called to make double-sure, I was told "no", Ernst's visiting hour was Monday at 1 p.m., but Ernst would have to sign a visitor sheet.

I told the person on the phone in charge of procedures that word had come to me that Ernst would be shipped "elsewhere" - and was there any way to make an exception? I simply HAD to see him.

A very curt "Sorry!" Next Saturday.

I said that really WAS strange - I had been told if not today, then Monday.=

Well, sorry, Ma'am! Next Saturday.

A friend who is a minister volunteered his own visiting slot over to me. I called again and asked: Could I come? I KNEW there was a slot. The icy answer was: "No, only Monday." All slots had since been filled. I said it was odd - I knew for a fact a visiting slot had just opened. Today was Saturday. Well, I was not on the visiting list.

I said to double-check. PLEASE double-check.

No doing. Back and forth. And yet more back and forth. With gritted teeth I insisted, and after hearing my story of woe of the Royal Runaround, a supervisor finally allowed me to come in at 12:45. He gave me his word he would make sure I would be on the all-important list.

I drove there two hours early, expecting more trouble. Guess what? I was not on anyone's list. I said I had been promised. Sorry. The supervisor who had promised me had left.

Yet more to-do. In the end, a list was found. Eureka! It even had my= name.

Another problem next arose. Where to find Mr. Zundel? He wasn't here. He wasn't there. Sit DOWN, Mrs. Zundel - and WAIT!

To make a very complicated story short, somehow a miracle occurred, and I was buzzed upstairs.

As far as I can tell, shifting Ernst from floor to floor was nothing but harassment. It was meant to prevent me, and probably others, from seeing and talking to him. Those are the times that make you thankful for your ancestors' genes that instruct you exactly just how deep to dig in your= heels.

So there was my dear love, behind a glass partition, wearing the striped prison garb - just like in the movies. And for what? For having missed a hearing?

Ernst and I talked for an hour. Is he well? Yes, to all appearances. He isn't treated badly. "But everything," he told me, "is unpleasant."

The food is a disgrace, and very small portions are given. He shares a cell with only one other person who gets moved back and forth as well. One night he had to spend with a howling and utterly deranged schizophrenic. Now he has a "roommate" who seems to be all right.

I won't pretend this is a lark that Ernst can take in stride. During the three years we have been together as a married couple , I have become keenly aware of how beauty-responsive and aesthetically sensitive Ernst is. His soul is wide-open to beauty. A sunset, a spring blossom can make his entire being just radiate with joy. It must be very hard on him to know that from 5 p.m. to 9 p.m. he is allowed to share in the company of whatever else is locked up in that place - and if he chooses not to partake in inanities, he cannot go back to his cell.

I believe there is a good chance Ernst will be moved back and forth across America to avoid any meaningful strategy of freeing him in a concerted effort. Colloquially, it is called Diesel Treatment. Another possibility, of course, is that he will be shipped to Germany so fast that all we'll see is dust clouds. Our best chance is delay - and supporter involvement and outrage! Ernst feels his supporters should use as many avenues as they can to spread the word and tell his story - but, please, always with class and discernment! Don't get vile. Don't get abusive. Never forget who we are. Let's leave the filth and violence to our enemies - we have nothing but nothing in common with them!

Media-wise, it's been a mad-house! The story of the Zundel arrest is trul= y all over the globe! I have had news from as odd a place as Malta! Briefly, this morning, the Zundelsite was down. We manage to resurrect it. So far this month, we have had 670,661 visitors, which looked at 2.3 million different pages on the Zundelsite!

You guys hang in there, and I will, too. I must admit that this prison visit - my very first ever! - has done a real number on me. But the line in the sand has been drawn.

ZGram: 2-9-2003 Your mail has been just wonderful, and I shall post some excerpts separately on the Zundelsite for people to take heart. The media exposure has been spectacular once more, though most of it was poison. Regarding local media, there were two first-page write-ups in my county and city papers - the first one not too bad except for the inflammatory headline, "Neo-Nazi activist detained in Blount jail", and the second, I am told, actually quite fair. I haven't seen it yet.

I asked for your input on how to handle lapdog media. I have had many responsible, thoughtful replies. I also talked my ideas over with Ernst, and he agrees with my conclusion to put ourselves smack in the driver's seat and let the Schmierfinks come to us. I won't cooperate with hostile media. Our cooperation in the past has yielded precious little for truth in history, if anything at all. I am hard-pressed to think of a single example in decades of trying and begging mainstream media to let us have a voice so we could tell our story. No more. It did not work - not ever! Folk wisdom has it that the definition of insanity is to do the same thing over and over again - and expect different results. I say we HAVE the internet. We need to USE the internet.

I drafted a quick letter to the Editor of a Canadian paper:

Thank you for today's largely balanced coverage of the illegal arrest of my husband, Ernst Zundel - for having missed an immigration hearing of which he was not notified. There is one item that I feel I must correct: Ernst did not leave Canada after he was ordered to shut down "his" website - it was, and is, my website, as everybody knows. Ernst Zundel left after Canada's Human Rights Tribunal ruled that "Truth is not a defense." To get that Human Rights obscenity written into law, Canadian taxpayers paid through the nose. Ernst paid for his own defense. Now you are one Ernst Zundel poorer and one disgusting hate law richer. Who made the better deal?

I told my readership:

Let's do it smartly and efficiently. Not only can we do it, we can also lead the way. The lapdog media needs us more than we need them. On principle, I will no longer make myself available to any mainstream media - with two exceptions:

I will do local media because I have to survive in this town and need to show myself as a mature and responsible neighbor, and
I will cooperate if mainstream media submits written questions. I will reply in email so as to have a record of what I said and what got into= print. No other way. That's it. Let's make ourselves scarce and play haughty. The information we are eager to get out is all available in cyberspace. If media whores then lie about us, their lies will burn their faces.

We in the patriot, dissident movement have been reactive for decades, begging and groveling for some tiny crumbs of exposure, always on the receiving end of horrible abuse - and never getting a fair shake. Never! We have been slandered, smeared and vilified with utterly shameless tactics - and we could never get a handle on "our thing". We have complained, but mostly to each other. We have permitted our enemies to write the script for us.

I say: No more! As far as I am concerned, from now on I am in control.

ZGram: 2-11-03 I am walking around the house with three telephones hanging from my belt! The calls are simply non-stop! We are working on several strategies. I was told this morning by a very nasty person in the Memphis INS office that Ernst will be deported just as soon as they can manage. Therefore, publicity about this case NOW is CRUCIAL!

The most urgent questions to be asked are:

Who ordered this arrest? Who signed the deportation order?
Is it customary to arrest a person on an alleged minor immigration violation by five (!) agents?
What are the procedures to prevent deportation to Germany where Ernst would be convicted and imprisoned [of Holocaust denial]? What are the steps? Who should we contact?
What happened to the First Amendment guarantee? Are people in America still free to speak their conscience?

In a great hurry, I next wrote down some background information to be shipped to media upon request:

Ernst is a German national who lived in Canada for 42 years. He applied for citizenship twice, and was twice denied. He was not given any reason. This means that he is still a German citizen.

In Germany, "Holocaust Denial" is against the law. You can get up to five years in prison for "... defaming the memory of the dead." Many people are in prison for "Holocaust denial" and thousands have been prosecuted. I know that this latest arrest is meant to deport Ernst to Germany on a technicality where he will be charged, sentenced and imprisoned without being allowed a defense - even witnesses and attorneys are charged and punished for aiding a defendant on trial for "Holocaust denial".

Once Ernst is convicted and imprisoned, somebody will make sure the key is thrown away. I fear that even worse could happen and that his very life will be in jeopardy.

We have lived at the same address for more than two years. We are listed in the telephone book. My husband has an American Social Security Number, a Tennessee driver's license, and a work permit. He has been vaccinated and fingerprinted, as requested by INS. We were told that the next step would be a personal hearing before an immigration judge, but that this could take as long as 36 months.

In May of 2001, we received a request for an immigration hearing. Our attorney could not make it, and he requested a re-scheduling. A copy of this request exists. It is dated May 23, 2001.

Our attorney wrote to INS: "I am in receipt of your appointment letter for the interview concerning the application for Adjustment of Status of Mr. Zundel. Unfortunately, I will not be able to attend this service and am requesting that it be rescheduled...my schedule conflict(s) and I am respectfully requesting rescheduling of this appointment."

There was no reply from INS.

Our attorney wrote again on May 6, 2002, one year later, this time sending the letter certified. I have a copy of this letter and a copy of the return receipt; the original is kept at our attorney's office.

This time, our lawyer wrote: "Please be so kind as to reschedule the interview that was cancelled last year on June 12, 2001. It has been quite some time and surely this matter can be advanced for personal interview." INS did not reply.

Ernst and I were not overly concerned, since we had been told that procedures could take as long as 36 months. We simply awaited instructions.

ZGram: 2-12-03

This morning the local paper carried a lead article that stated that Ernst would not get a hearing before being deported to Germany just as soon as Germany was ready to receive him.

Meanwhile, I was left out in the cold. Nobody told me anything. All week long, I had called every lead that was given to me, ?trying to pry two questions out of various agencies and authorities: Who signed the arrest warrant - and what would happen next? Of all the many authorities I have contacted, it was our local Chief Sheriff, the official who had accompanied the INS officers last Wednesday, who finally returned my call.=

This Sheriff absolutely would not tell me anything - but I did get him to admit that he had been in his position for six years in a supervisory capacity and had NEVER experienced the kind of arrest that Ernst endured last Wednesday!

I have not talked to Ernst today. He tried twice, and twice somebody tied up my phone. Please don't call me - you are just making it more difficult for me!

I don't know what will happen next. A spokesperson in the Louisiana Regional INS office - I believe her name is spelled "Maow" - told reporters that, "in layman's terms, Ernst Zundel is out of legal immigration status"= , that he "might" get a hearing before a judge "if it is appropriate", and that "he could be removed without going to a judge."

That is an ominous statement! Because of my husband's high political profile and the enormous power of the Holocaust Lobby in America, I fear that his enemies plan to whisk him out of the country to Germany just as fast as they can. If they succeed, a conviction for "Holocaust denial" in Germany is a foregone conclusion. As a German national, not only would Ernst get 5 years in jail, he would be prevented from returning to America for ten years because he would have a "criminal" record!

ZGram: 2-14-03 Frantic action is an understatement here at Tennessee Zundel-Haus. We have all kinds of legal moves going on behind the scenes - as, I am sure, is true of our enemies as well. The story is still breaking. Here's what I have found out so far:

There is no arrest warrant. None! This is described as a "civil arrest." Welcome to the New World Order!
Yesterday, against the greatest of all lawyerly odds, we managed to file a petition for "extraordinary relief" in Federal Court - and did not even get a hearing. A one-sentence judgment by Judge Jarvis: Denied. Now comes the weekend, and not much will get done. In the meantime, there seems to have developed a three-way tug of war between the U.S., Germany and Canada - who will take Mr. Zundel and inherit the publicity? As far as I can tell, this sadistic brutality was planned to have taken place on the sly and handled very quietly, but the Internet saw to it that the story broke - and from there it was media mayhem all the way. Some of my readers thought that I did make a mistake when I restricted my interviews only to alternate media. I believe that this strategy worked. The media write-ups and broadcasts HAD to get their info from the Zundelsite, and so far it has paid off in advertising millions. For instance, NBC is said to have run it - I am not sure when, but somebody sent me a tape. They showed the Zundelsite. They showed some very good titles. They even showed the Sinking Auschwitz cartoon. No yammering Holocaust survivor! This was prime news. This time, at least as far as the media is concerned - they didn't run us. We sat back and forced them to be a bit more polite and civilized. WE controlled what was put on the newscast by forcing them onto the Zundelsite. It felt like sweet revenge.

ZGram: 2-15-03 My neighbors are bringing me food, as though we have had a family funeral. There was another court decision yesterday. We had less than a day to prepare an appeal for "extraordinary relief", as it is called in legalese - but there simply was no time to tighten up the petition. We were turned down. We are regrouping. I just wanted to let you know that I am still around - and that this is a fight to the bone.

Through the grapevine, I have been told that Ernst will be deported on Sunday - media reports say either to Germany or Canada. My next visit is scheduled on Monday. I may not even get a chance to see him one last time.

There were letters and faxes galore. I wish that I could run them all. I have space for only three:

Your present circumstances, awful as they are, are of course a badge of honor awarded to the best of our leaders in this most crucial of struggles, since on it depends everything we hold dear. You are in heroic company through our kind's age-old struggle for truth, freedom, and right, without which mere existence matters little for our kindred peoples. I hope you don't suffer too much, and I'm sure you will triumph.

From Dr. Dommergue in France to American officials: I have known M.Zundel these last 20 years and as a Jew I felt compelled to check what he said and published. I became conscious of the fact that he was a most distinguished mind, that he told the truth and that I could understand why my all-powerful peers did not like him!

I feel that a country in which he resides can be proud of having him.

Please give him back his liberty in the country of liberty, and keep away from the totalitarianism of my worst peers who think they have all the rights because of their financial and political power.

2-5-02 Some kind prisoner is lending me a pen - a very rare commodity in here. I will only be able to order one on Monday, to be delivered on Thursday, a week from now.

The deportation order I was shown had no date on it. It was added in the office afterwards by the INS guy who arrested me. It said that we were informed May 18, 2001 to appear for a hearing in June. Since we did not appear, our application was considered abandoned - that there was no appeal against the order of deportation. This means I'll be barred from the USA for at least ten years automatically and will only be allowed to re-apply pleading special circumstances. With my enemies, you can be sure that it is no more coming back!

You must not come to Germany or Europe, Ingrid. [Your handicapped son] needs you here. You must be strong now. Please be careful.

2-6-3 Terribly noisy prisoners all evening long. Finally fell asleep - was awakened by a loud banging on the cell door. A white officer kept pounding on the door, motioning me to come down from my bunk. Did not address me by name, just bellowed, "The armband!" and motioned me to raise my arm so he could read it. He wrote down my name on a clipboard, turned on his heels and left.

Robert, my fellow inmate, shot up, hollered into the intercom "This is not a prison anymore! You are free to leave!" A few minutes later a smiley young guard came by and inquired who had spoken. Robert said he had, repeated his "You can all leave now! This is not a prison any more!" The guard smiled, joked with him, and left.

Before this incident, Robert had called on the intercom and demanded that they open up. He wanted to take a shower. The time was 10:30 p.m. They [the guards] denied it.

2-7-03 Robert, fellow inmate, bought lots of stuff from the commissary - all sweet twinkies. Promptly had massive hallucinations and shortage of breath - wheezing, shaking violently, twitching.

Very restless night. Awoke at 6 a.m., cold, shivering. Fellow inmate gets up suddenly, makes intercom call to front office, demands in a loud voice to be let out, that he is a government official. The guard on duty tells him to be quiet.

I'll try to get a shower today. Phones are unreliable - lots of inmates per phone, at the whim of the guards mostly.

1:15 p.m. Called Ingrid, finally got through. Good news. Lots of people are rallying. Now everyone will know and get busy with pressure campaigns.=

Had medical today. TB tests, blood pressure 170 over 100, supposedly high. Little wonder! [ Attorney ] has not contacted Ingrid. Must work out a strategy.

I called the officer on duty, front desk, asking that Ingrid be put on a visitor request form. I was told when I came in and, in fact, was given a slip in writing, that my visitors' time was Monday, 6 p.m. Now I am told [it will be] Friday, 3: 15 p.m., - no, that it has been changed to Saturday 1:00 p.m. arbitrarily. No one advised me. I was only let out [on Saturday] for an hour at 1:00 p.m., so no time for Ingrid to make it here. I told this to the officer. He could not care less. I asked if I could be let out for a brief phone call to my wife. "You can call her tomorrow!" They are the coldest, most impolite, curt people - amazing to me! I sure had different ideas of American public officials.

This, too, will end.

I found out today that I am in a high security, in fact maximum security tract, on 23 hours lock-down. One hour for phone calls, showers, walk-around, with only my cell mate, who constantly talks out loud, hollers night and day, seems [to be] on manic depression medication. Weird fate!

I knew the dreams could not last.

I requested since yesterday, 3 p.m., that Ingrid be notified of the change [of visitors' hours] or I be allowed to call. "No!" was the answer, coldly. "She can see you in a week." Guards one-third my age are playing God.

I write these lines, using up my fellow inmate's ball point pen and, even more precious, some sheets of his papers worth their weight in gold.

Still have my cough.

2-7-03. Four big guards came in the afternoon. Ordered me out of my cell with my stuff, took me to the corridor, threw my mental cellmate on the floor, kicked him, pummeled him 'til he was dragged along the halls, bleeding and screaming. Eventually, I was put into the general population, which meant three times out of the cell.

Attended a black preacher's Bible circle - [audience] one-half black and one-half white.

New cell mate is [ name deleted ] old, broken, but a kind man, 65 years= old.

Ingrid came to visit - looked nice, young, lovely, bright, alert. We had a good, long strategy talk. Good news from outside.

2-8-03. Sunday started normal. Then all were ordered into cells, locked in. NWO cops with visors, helmets, bullet-proof vests, Dobermans or German shepherds came in shouting commands hysterically, threw us on the floor, face down, putting twisting arms behind our backs, handcuffs to cut the flesh etc. Finally we were dragged half up, dumped on the floor outside two feet away from [ unreadable ] covered with helmets, [unreadable] black-uniformed troopers while they emptied our plastic bins on the floor, threw eye glasses around, emptied pockets etc. This went on for at least two hours in the whole prison. The toilets were shut off for these two hours. The dogs barking, prisoner cries, guard shouts caused mayhem everywhere. Amazing place - what would Washington, Jefferson have thought of this?

I am painting in my head, storing it in my Rolodex file. Trying also to do the same for the newsletter, but really want to wait till I have heard from the lawyer exactly what he has undertaken, if anything at all. I find it shocking that he did not find it necessary to call Ingrid or respond to her for three days. Now 3:30 p.m. Pencil is getting dull.

2-11-03: My dear Ingrid - It was so good to talk to you - three times today, and it was good that we had a little longer to talk, even though the noise in this place is almost unbearable. The young black inmates are the noisiest ones - they are rowdy, roaming around, tussling with one another, throwing homemade balls clear across the area where we are condemned to spend hours each day because the guards lock the doors within a minute or two after electronically clicking them open at 7-9 a.m., and then again at 11:30 till 2 p.m. Then we are locked into the cells till 5 p.m. when the procedures reverse themselves and we are locked out of our cells till 9 p.m.

Each time period we are fed either breakfast, lunch or supper, which consists either of two pieces of the typically spongy American toast bread, rarely toasted, usually just limp and soft, no nutrient value. The food is served in rectangular serving trays of plastic, re-usable, sturdy, wine-red in color. The depth of the indentation and the size of it is just deep enough to hold two pieces of limp toast, some porridge and one of the little plastic containers of jam we get at the gas station with ketchup when we pick up our chicken. We get one plastic cup of coffee, lukewarm - as is all food, from lukewarm to cold. I have never seen any milk with the coffee, not in powder or cream form, no sugar - only one tiny Nutrasweet baglet. Sometimes we get cold, oversweetened tea. That is breakfast.

For lunch, it is two pieces of limp toast bread, some watery corn, only "one toast" deep, or sloppy liquid beans, carrots, or those odd greens they eat around here. Mashed potatoes, "half-a-toast" deep, some Sloppy Joes, one of our large serving spoons deep - much less than a scoop of ice cream. On some days it's chicken salad, tuna salad, and five to six slices out of a can of soggy apples, pears, peaches, fruit salad. The odd time there is one of these small flour biscuits and gravy. One small apple - the only alive food in one week, which I chewed, spat out, rubbed between my toes to control my athlete's foot which I contracted in the shower - it worked!

Medical care is laughable - aspirin, cough syrup, which you have to take in front of the guards, or you won't get it at all - for which you apparently are charged $5.00 minimum. You must put your request in writing on Monday and you get it only on Thursday, regardless of how lousy you feel in the meantime or how high your fever is.

It's very cold and drafty in the cells. I have slept with my striped prison uniform and my socks on each night since I got here. You get barked at via the intercom or chewed out in person if you do not understand their arbitrary commands. At lunch time today, all the prisoners in our area, maybe 40 or so, were punished because some unruly young Blacks did not stand in line and were jostling around. So the other 400 or so inmates were fed, while we all waited till the stone-cold trays came around again.=

I can just imagine what will happen when the New World Order types get their mass arrests going to fill their 1 million head, massive camps in superhot Arizona or Mexico. They will die like flies there. Believe me, Ingrid, after seeing and actually living this reality, we Germans have absolutely nothing to apologize for - not for the diet, not the daily routine and the treatment of the prisoners there in Auschwitz, Birkenau, Majdanek, Dachau etc. NOTHING at all! Felderer [a Swedish Revisionist] showed me the slides of sculptures of classes in Auschwitz. He showed me the photos of the script of the Auschwitz Waltz, composed there during the music lessons. Christophersen [another Dutch Revisionist who in his youth worked at Auschwitz and even spent his honeymoon there ] told me that he needed watercolors for some plant illustrations in Raisko, the experimental camp in Auschwitz where they did research into turning dandelions into rubber. He had to ask one of the fellow Jewish research doctors who got the watercolor paints from her storage area in a place they called Kanada where the Jewish inmates stored their stuff.

I have seen no newspaper, no news magazine, seen no TV, [and listened to] no radio in this place. The "library" books are on a wooden trolley as in the run-down areas of any downtown US inner city Goodwill store. [This trolley] has trashy, sexy novels, very few 10, 20, 30-year-old self-help books, only one or two high school picture textbooks about American history or Life Time.

Your hair on your head would stand up on end at the utter inferior [quality] of all kinds of racial mixes, many with the definite look of Alcohol Syndrome babies. Many lousy teeth, emaciated sick looks - I would say 90% with the most incredible tattoos all over their bodies - simply amazing! I would have to say that 99% of these inmates have done drugs, dealt drugs and were/are alcoholics and heavy smokers. All of them are craving sugar to a degree I find astonishing. One can buy Twinkies, Hershey Bars of every size and description.

Candies are bought by the ARMFUL. In one week, my first cellmate ordered 40 bags of Nutrasweet, 40 kinds of fizzing, totally artificial kinds of pop, all junk, and then had shouting matches with some invisible demons day and night, without provocation jumping up in his bunk so hard he banged his head on the metal plate which is my bunk. He charged across the cell, pressing the emergency call button and berating the guards with verbal abuse till they finally put an end to it by yanking me out of the cell with all my bedding etc. and relocating me from my maximum security tract, 23-hour lock-down to the open range area I described earlier. [Given another cellmate] I would have preferred the solitude of that "punishment" to the zoo of the other, "better" area.

I have pretty well interviewed most prisoners, Black, White, and Mexican, for what crimes they are in. Some of the horror stories are so grotesque that nobody would believe me. There are many young Whites here in the 20-25 year range, some a little older, who face 85 years, 78 years, 40 years, 30 years. There are many repeat offenders, mostly drug- and alcohol[-related], and dozens who are in here for driving without a license, because it was suspended for drunk driving, over and over again. Some are doing 18-20 years for that, cumulatively.

As a consequence, this place is seething with rage, dozens of cooped-up men with a grudge against the police and the justice system, that does not portend well for the future. I dare say that there are almost a dozen killers here, just waiting to get out who, perversely, live and seethe for the moment of revenge. There is a vicious cycle going on that cannot and will not be broken by this current system - only recovery/rehabilitation programs through healthy, meaningful work and an accompanying citizenship/civic responsibility educational program can even have a faint hope of recovering these dregs of humanity, eternally looking and griping for scapegoats, downbred to an unbelievably shocking degree, simply unbelievable! In the middle of the night I was startled by being poked in the ribs with a flashlight. I had left a book on the window sill. I was ordered to take it down at once.

2-12-03: One other little inconvenience they employ here is that they put you in hand cuffs and leg irons, like they did in the old days to slaves. Not only the wrists but also the legs are cuffed, attached with an 18 inch long steel chain which makes walking every step painful, as the hard, sharp edges of the steel cuffs chafe and cut into one's skin and flesh.

Every third day is razor-obtaining day. At 6:00 a.m., they call out by loudspeaker to get your razor at the slide-in little hatch door in the main commons area where they also slide the food trays for the inmates. A guard with a list of all the inmates' names and cell numbers notes them down and hands you a cut-off Bic disposable razor, which you must use immediately and have ready to turn in to the guards who will check your name off: razor returned. Irv Rubin would certainly not have had much time to break into that plastic-cast razor without any metal tools, of which there are none. [For readers unfamiliar with Irv Rubin's story: He was head of the California-based Jewish Defense League, in prison for planning to blow up an Arab mosque, who allegedly cut his throat with a razor and died. Street talk has it, not unreasonably, that someone from the Nation of Islam, also imprisoned, did him in. Just a few days ago a woman from Montana e-mailed me that she had once encountered Rubin at a Survival Expo, where he had bragged that he had torched the Zundel-Haus in 1995.]

Another item which is typical for what's going on in here is the cost of things the prisoners can buy. [Cheap] running shoes with Velcro straps cost $5 to $7 at Big Lots or the Dollar Store. Apparently, here they cost $18.- plus tax. One of those headphone radio sets at Big Lots or WalMart cost $15.- [here sells for] $42.- plus tax. Somebody is gauging these poor human wrecks.

I made a mistake earlier re food amount. The squares in the trays apart from the toast and porridge are only 2/3rds the size of a piece of toast and I have never seen one of those tray areas even half full with things like apple sauce and chicken or tuna salad. All the prisoners complain of being constantly hungry. Drug addicts craving sweets trade their meager rations for candy bars.

2-12-03: We are locked out of our cells. I write this, surrounded by other inmates. I had lots of time to worry about my situation last night and how it got to this unfortunate juncture. It was clear from the ruling [my attorney] was so reluctant to fax you and apparently never did that the INS used the excuses of a.) my overstaying my three-months' visitors visa and b.) not showing up for the May 18 notification for the June 2001 hearing. About the hearing, I remember [my attorney] saying that he had a court date with a court higher in level and rank than the INS hearing, that he would write them and ask for a re-scheduling. He insists he did it. He told me at the time that this was a mere routine, and he had that happen often in his courts. There was nothing to worry about. [He said:] "You are legally married to Ingrid. That's what counts." He reiterated the kind of proof of our marriage being bona fide - like owning property together, drivers license, insurance, credit cards, photos of social gatherings with friends showing us as a couple etc. We did all that and had all that. I remember fretting all the time!

I also remember how absolutely frantic I was when [my attorney] did not file our papers as the deadline approached for my American visitor's visa to expire. He did not respond for almost six weeks, never returned a call, never sent a fax, because his secretary had a baby and then he merged with a larger law firm. [Ingrid's comment here: We have that original letter that we faxed him at the time, and it IS a frantic letter!] I now believe that they used his sloppiness or tardiness to say I was here overstaying my visa expiry date. I communicated all my/our reasons, over and over again. The man would not move or respond, which never happened to me with any lawyer [except one]. I am so sick of lawyers and courts and legal proceedings. It's almost like a form of mental and soul torture to me. I do not know if you ever understood that feeling of mine. That's why I so enjoyed our mountain, the potato patch, gardens, berries etc. THAT WAS REAL. I buried a seed in the dirt and watched with utter fascination how the warm weather made those tiny seeds germinate and grow into beautiful heads of lettuce, or flowers, hanging garlands of beautiful nasturtiums.

But back to the real and nasty world. [Our attorney] bows out because he knows he has partial if not total responsibility for our fix. He has to practice immigration law in Memphis to deliver for this big law or state because they will come before the same judges over and over again. So if they fight too hard against the system for a non-trendy, unpopular client or cause, against the same judge for a different client, judges will hold it against the lawyer, and the next time, as in appeals, a feisty lawyer will be slapped down, along with his client. It happened to me over and over again. Judges are human, even the best of them. They all are moved and motivated, pulled and tugged, by the forces outside the courts, in media, in government, parliament, by the preference of ministers, be they liberals or conservatives.

I read a book in here this week about The US Presidents and Their Times, wherein it's clearly stated that presidents like Roosevelt wanted to dilute the US Supreme Court to "cut down on their work load" by expanding the number of judges. It caused a great controversy. The old conservative Supreme Court Justices blocked the move. Nevertheless, the judges saw the new reality and power make-up, the media-created popularity of Roosevelt, and began to bend and yield. In the end, Roosevelt's leftist ideology prevailed - and America was changed forever. Eisenhower appointed former Governor of California, Earl Warren, to be the new Chief Justice of the US Supreme Court, thinking he was a conservative, middle-of-the-road, uncontroversial judge.

"Instead," says the book, "Warren led a revolution on the Court, especially in the area of civil rights." Eisenhower apparently later said that "...appointing Earl Warren was the biggest damn fool mistake I ever made." Which is amazing, since all these high public officials were Freemasons who believed in the tenets of the "Universal Brotherhood of Men." Nixon and Reagan were faced with the same problems and never did solve the issue. The Supreme Court revolutionized American society the way no political party ever did to this day. It was my misfortune all along that these are the realities of the legal system. That's why, in the end, I found not a single court [in Canada], with the exception of Judge Heald in the SIRC/CSIS Security Threat case that gave me any fair judgments. I sensed it. I knew it. But principle and timing and my own situation with a deportation hanging over me like a Damocles Sword and five to eight years in jail facing me in Germany [were] a foregone conclusion - unless I gave up, went over to the other side like so many lesser people did. We were forced to fight in the enemy's sandbox, the courts, forced to play by their rules, financially bleeding to death by their Kosher-style shafting techniques, our life's essence draining out of us while being fully conscious, just like any cow or sheep in a ritual butchering.

Had we been able to coalesce the Germans in North America, we might have had a chance for a Mexican stand-off, but as it is, we never got very far with our attempts. By our marriage and coming to the US to live, we won a reprieve, which was one of the most wonderful and enchanted times of my= life.

All this aside. The reality is my deportation. If I were outside, I would have a little room to maneuver. But that is why I am on the inside - my enemies know me too well.

All people have a modus operandi, especially in military campaigns. It is a given that the longer a war lasts, the most certain aspect is that it will turn into a WWI and, in certain respects, a WWII type slugging match where, ultimately, the preponderance of men and material will overwhelm and overcome even the most tactically brilliant but numerically inferior opponent. Thus the Germans could only win in WWI and WWII if they were successful in routing their enemies decisively in the first two-three weeks, at most months. After that, victory would come into question, and unless the enemies made major tactical or strategic blunders, [victory] was not going to happen.

One of the reasons was race. White people, with the same cultural background, philosophy of life, training, skills and even military doctrines coming out of antiquity with only slight improvements because of modern technology weapons development, made temporary victories on local fronts possible. But overall, the modus operandi was what white brains, white genes produced, could conceive, and were willing to execute. The other side, as in the case of the Soviets, headed by an alien clique, fanaticized by the Commissars and the likes of Ehrenburg, overwhelmed us. Their tactics had a non-white, alien, vengeful, cruel, murderous, hateful component which the Germans could never instill in, and thus never get their troops to practice, in the field. Israel, and to a lesser extent, America know these facts - and certainly in all the wars after Vietnam paid heed to them. Assemble overwhelming forces, unleash them no holds barred, conquer the physical territory, destroy the enemies' command and infrastructure and establish occupation regimes backed up by your own, i.e. the conquering troops. Quell all resistance. Eliminate the enemies elites - educational, cultural, military, police forces - as the Israelis did in Palestine, the West Bank, Gaza, and as the victorious Allied did to us in World War II.

That is where we are at in warfare, even in business and in culture. You can weaken an opponent by manipulating his currency, debauching it by inflation, blocking it by not allowing it be traded internationally as they did [to Germany] IN 1945 until Adenauer agreed to pay Israel reparations. Only then did the US Military Governor allow the Deutschmark to be used as an internationally usable currency. They did the same to White South Africa where still our US banks don't accept South African Rand, as you= know. The way I see it, there is only one way out of this dilemma, and that is to leave [our enemies'] mental playpen they have created for most of mankind. We must think our way out while seemingly still playing their games by their rules to fulfill their needs and their wishes for us. Since this is a decidedly materialistic world, we must try to free ourselves from materialist desires or golden handcuffs all around. We must become self-sufficient in as many areas as possible, self-reliant - not in a crackpot, open way [which would] bring down retaliation on us - just quietly working, doing our thing, building constructively in every area of life we possibly can, not rocking the boat, not showing up on the enemies' radar screen. Our gene pools are so depleted that we have to rebuild them, one child at a time. Slowly. Imperceptibly. Steadily.

12 p.m. We have had our lunch, soggy limp bread, one slice of baloney and one slice of that packaged American processed cheese we sometimes buy at Kroger's, 20 French fries, small ones at that, one plastic little baglet of ketchup, one of mayonnaise, one cup of cold water, better in taste than the tap water. That's it. I was able to get on the phone - there was a big line-up. You must be in town, for there was no one home.

I am preparing for that habeas corpus motion. [Our local attorney] has never done one before. Luckily he prepared some research the night before on the Internet. Sounds like a first-year law student, falling back on the Internet. You certainly were right when you said he did not seem to be too aggressive.

Now to other topics. Apparently, some prisoners who knew deportees say that I will be taken to Atlanta. It usually takes one day in handcuffs and leg irons in a bus. Then they keep you in an Atlanta prison or detention center for approximately 2 weeks, and then it's off to wherever they send you, again in handcuffs, accompanied by a US Marshal or INS personnel.

Now, Ingrid, read this carefully, and be prepared for it:

1.) It would be helpful if we had an affidavit from [my Canadian attorneys] saying that they were my lawyers and that in all these years, I never missed a court date, hundreds of them, in 20 years of court appearances. They should fax it to you. It will come in with the lawyer if we ask for a bail or bond hearing. Talk to the [local attorney] about it since the weekend is coming. If the last-ditch move does not succeed, ask the [local lawyer] to drive by here, get a visit with me at once, so you and I know what we are facing - when! He can come anytime, you only once a week. Should I be shipped out quickly, cancel the visit of [friends]. Tell [my sons] that I cannot call to Canada. The calls are blocked. Amazing but true.

I understand that I have to pay for my own deportation flight plus some costs to the county jailhouse here. So please be ready to carry my credit card or leave it at the jail during your next visit. I will ask them to charge my deportation flight to my credit card so I can have some spare pocket money for a taxi, a hotel, some food. If you could bring my temporary US work permit, my US driver's license, a pink copy of the Crown Vic insurance papers and leave it at the jail with my personal belongings, then I could hopefully drive a car. Hang on to all other cards - social insurance number from Canada, my landed immigrant paper. Treat the whole wallet as a precious document - it's important documentation.

Should I end up in Germany - I have only 200.- to 300.- Euro left - begin to build a little [cushion] for us. Try to pay any legal fees in installments. If I am directly shipped to Germany and will be arrested there, then they will take me from Frankfurt to Mannheim like Hans Schmidt and [Fred] Leuchter. Then a new round of trials and convictions wait. Minimum 5 years because I have been previously convicted for [Holocaust Denial]. Maximum 8 - 9 years if they do it like they did it to G=FCnther Deckert. Salami tactics - six months for this, one year for that, two or three years for something else. Not a chance to return to our mountain, you can be sure.

Always remember that I will make every effort to be in frequent touch with you. However, Ingrid, a very much more difficult period of our life began on that lovely, sun-filled morning when they came to arrest me. It is the nightmare of all my nightmares to have to fight in the courts of an as yet strange land with strange lawyers who really do not understand the world, have no inkling of the most fundamental facts of European or world history, never mind even the slightest idea of the topic which has led to my 30 years-plus persecution inside and outside the courts of four countries on two continents. The level of the most basic understanding of how an occupation by victorious nations can and does impact on and warp even an allegedly democratic system is and has been totally missing from any of the attorneys here, any reporters I have talked to, any prison guards - with possibly one exception: the new retired Special Agent Nowinski of the FBI, whom I went to see with my lawyer to be questioned at FBI headquarters - so long ago, it seems now in retrospect. He had a grasp of what was what. The others don't have a clue and lose interest within five to ten minutes when their gaze begins to wander.

[True also of the inmates here.] They are all almost incapable of holding any abstract thought or concept unless it is about food, booze, drugs, sex, their sentences, why they are in jail. Most of them actually are incapable of realizing that much, if not most, of their troubles are self-caused. I am afraid that rehabilitation would only be possible if one wanted to recover them by a brutally strict boot camp, putting them on water fasts to detoxify their completely gucked-up systems. They are daily overdosing on artificial sweeteners, jam, artificial syrup, candy bars, M&Ms, toast and mashed potatoes, with no physical labor to give them exercise to get rid of what are essentially neurotoxins. If the American Army eats this same stuff, I predict defeats after defeats, because these mis-fed, untaught human beings cannot sustain a campaign which demands sacrifices and staying power. In my opinion, that goes for Mexicans, Blacks and every shade of White.

By the way, there are relatively few blue-eyed and blond White inmates. [Even Whites] have usually thick, jet-black hair. They have one thing in common - the largest percentage of them have the most grotesque, vulgar tattoos. The few young white men, 18-23 year-olds, speak the jargon of the young Black "...you get what I'm sayin..." Every second word is "M...f..." even by Whites. Vulgarities that make a grown man blush run out of these young men like Niagara Falls.

Some kind, slightly mental inmate has offered during breakfast to let me have a prison pen with short, soft barrel which bends while pressing on paper in exchange for a drawing and a book on America's National Parks. How beautiful these parks are! I have done his sketch of a Cades Cove Park grist mill and hope - the pen is running low on ink already - that I can keep the pen a few more hours. I have a lead on a new lawyer. I'll call Tuesday morning. I have two brand new little sketches, drawn in prison, which Ernst sent to me. One is a print of handcuffs above the Smoky Mountains. The other is a Valentine's 2003 card for me. Of each, I will make 100 prints, number them and sell them at $100.- each so I can pay our lawyers, at least initially. Good Morning from the Zundelsite:

Some of you are on my "other" lists - so if you get this message double, or even triple, please bear with me. It's been 12 days since Ernst was arrested, and they haven't been pleasant days, as you can imagine. Somehow, we held our own.

But today I could feel myself getting weak in the knees, for there was, all of a sudden, a very strange, eerie silence. I know it is a holiday, but the silence, after all the phone calls in the past few days, was beginning to get to me.

I thought that today was my day to visit the Detention Center, but having gotten the runaround before, I thought I'd better call.

The operator said that Mr Zundel was no longer there. He didn't know where. He didn't know why. He said to call INS.

I called INS, and I called whoever I could think I should call, and other people started searching, running into brickwall after brickwall. After three assassination attempts on his life in the past, I was beginning to worry.

It is now 6:20 pm. I just got off the phone with Ernst. But listen to this - you will not believe it:

INS agents took him by plane from Knoxville to Canada with a judge's order that he was BARRED FROM ENTERING THE US FOR THE NEXT TWENTY YEARS!

For having missed a hearing???

At any rate, that is the story now.

Ernst was in Canada for about an hour. Lots of shouting, gesticulating and wringing of hands, and then they shipped him BACK!

Which means they themselves violated the judge's ruling within an hour's time!

Can you believe this turn of events? What on earth do they think they are doing? Or is this a setup for something?

He is in Batavia Federal Detention Facility now, apparently a smallish town near Buffalo. It is a much more humane place than where he spent the past 12 days. He has been told that Canada has now agreed to take him back after the paperwork is done. He thinks it might be several days until they move him once again across the border where he spent two-thirds of his life.

At any rate, we have gained a little maneuvering time. I'll be in touch - but I am so relieved!

Ok, so they have some Star Chamber hearing, bar Zundel from the US for twenty years, ship him to Canada without notifying anyone, then violate their own Kangaroo Court order within an hour.

This morning Ernst Zundel was removed from a Tennessee jail -- where he had been held since his arrest on February 5 at his home outside Sevierville -- and taken to Atlanta, and from there to upstate New York.

Today at 6:00 p.m., Eastern time, he phoned Mark Weber at the IHR office from an US immigration detention center in Batavia, New York, not far from the Canadian border, to report on the situation.

US authorities have issued an order barring him from the United States for twenty years, Ernst said. It is likely, he added, that he will soon be deported to Canada, where he lived for 42 years as a permanent resident. He then could be held in prison for having violated a Human Rights Tribunal ruling that declared unlawful the Zundelsite web site (http://www.zundelsite.org/index.html), which his wife, Ingrid Rimland, has run from the United States.

Ernst is in good spirits, eagerly discussing measures to be taken to deal with this new challenge. He said that he no money with him -- not a red cent -- because he took along no money or credit cards when he was arrested on the 5th.

Ernst and Ingrid are relieved that he was not deported to Germany, the land of his birth and citizenship, where he faces years of imprisonment for violating the countrys Holocaust denial law.

The arrest and deportation of Ernst is an outrage, especially considering that he is married to a naturalized US citizen, and has never been convicted of any crime in the United States or Canada. As anyone who knows him well can testify, he takes great care to obey the law and abide by legal regulations.

It appears that US authorities singled him out for deportation, using the pretext of supposedly violating a procedural regulation -- while ignoring millions who have been living in the United States unlawfully for years.

He is now in detention again, in a small town closer to Toronto, and I have been told by a mainstream reporter who is rather fold of Ernst that the Jews want to charge him all over again - chances are, for MY website, the very website they couldn't shut down for five years!

Are they now going to hold my husband as ransom in exchange for my Zundelsite? This is an American website. The Canadian Holocaust Lobby has no business messing with America's free speech, after they have so shamefully forced censorship laws onto Canadians - and then, to add insult to injury, asked the Canadian taxpayers to foot the bill to boot.

I have no idea where this is going to end.

I am talking to some important people and will fill you in when the time is right. I have always wondered if our enemies would take the risk of deporting Ernst to Germany, what with the pending Spiegel trial. If they do that, I believe that in Germany something will give. Too many people are informed. I know of at least two planned demonstrations before American Embassies.

Meanwhile, somebody shot out a big window in one of our buildings where we planned to hold our first art exhibit and community meeting, and damaged a second pane. I called the police who took a report and promised they would patrol our area. I am angry but calm. Believe me I am calm.

The Canadian media went wild again, as they always do when they think they smell prey. I stuck to my guns and told them I no longer would cooperate with hostile media. Mark Weber of the Institute for Historical Reviews fielded most calls.

A television crew based in Los Angeles visited our office this afternoonto conduct two interviews with me for broadcast on Canada's CTV network.

The first, conducted by Matt Cowan, is to be aired tonight on the 11:00p.m. CTV news. The second, conducted (by someone named Seamus?), was handled by speakerphone, but video-recorded, and is to air tomorrow morning on "Canada a.m."

The Department of Justice has assigned its top Nazi war crimes prosecutor to represent the government at today's detention review hearing for Holocaust denier Ernst Zundel, who is seeking refugee status in Canada.

Donald Macintosh, a senior federal government lawyer based in Toronto, has handled several high-profile immigration cases in Canada that involved allegations of war crimes committed in Europe during the Nazi era.

Dorette Pollard, director of communication for the Department of Justice, said Mr. Macintosh's appointment is not necessarily because of his experience in dealing with Nazi atrocities.

"It could simply be a question of workload. He is one of our capable lawyers, as they all are, in our immigration section," Ms. Pollard said.

It is not usual practice, however, for senior federal lawyers to represent the government at detention review hearings.

"Because of the nature of the case, a lawyer has been assigned," Ms. Pollard said.

Mr. Zundel, 63, has remained in detention in Niagara Falls, Ont., since United States immigration officials deported him to Ontario last week.

Mr. Macintosh has handled several of Canada's war crimes cases, including:

Helmut Oberlander of Waterloo, Ont., who is awaiting a decision on his appeal of a deportation order. He is accused of being a member of the German Einsatzkommando, a Nazi squad that executed civilians, and then lying about his role when entering Canada.
Conrad Kalejs, accused of being a leader of the Latvian Arise Commando, a group accused of murdering 20,000 Jews, was deported from Canada to Australia in 1997.
Johann Dueck was accused of being deputy chief of a police unit that helped the Nazis round up and kill people in German-occupied Ukraine. He was found not guilty in 1998 of obtaining his citizenship by false representation and was later awarded $750,000 as compensation for the prosecution.

Mr. Macintosh's experience and knowledge of the Nazi record make his selection to handle Mr. Zundel's case a sound one, said Keith Landy, national president of the Canadian Jewish Congress.

"Mr. Macintosh is well-known to us for the prosecution of Dueck, Kalejs, Oberlander and others," Mr. Landy said.

"The more knowledgeable a person is to the views of the applicant it will allow for a deeper and more thorough inquiry into the veracity of the claims. And he is, by all accounts, a very professional and capable prosecutor. "

Mr. Zundel's attempt to be granted refugee status in Canada has caused outrage and officials in Ottawa are trying to ensure he does not resume residency here, where he lived from 1958 until he left voluntarily in 2001.

During his time in Canada, he published Nazi and neo-Nazi views, associated with white supremacists and sought publicity for his notion that Germany has been wrongly accused of killing six million Jews.

The government there is little more than a branch plant of Ariel Sharon's Likud fanatics. Caught up in this mania is publisher Ernst Zundel. He's a pacifist. He's no Arab terrorist or threat to anybody except those who fear ideas.

On February 5, he was arrested by 5 INS officers and sheriffs. Ingrid Rimland, his wife, was told that he'd missed a meeting with the INS in May. Both he and his lawyer deny knowledge of any such meeting. A missed meeting seldom results in arrest and summary deportation. On the other hand, the INS had put out the story that his U.S. visa had expired. The cold INS bureaucracy moved him from prison to prison hell-bent on deporting him. One possibility was deportation to Germany where the anti-free speech laws of the vassal state would result in a 5-year prison term for Zundel. Instead, he was deported to Canada where Zundel was, for 42 years, a landed immigrant.

In a Z-gram (February 23, 2003), Ingrid Rimland writes: "My husband is a German-born national who immigrated to Canada 42 years ago, when he was 19 years old. He does not have a criminal record either in Canada or in the United States. He has to his credit a number of highly publicized trials -- fact, spanning decades -- initiated by individuals and organizations with a financial and emotional stake in a concerted campaign regarding what they call the 'Holocaust'. My husband did not ask for these trials --they did. In his own defence, he was forced to find out some facts regarding allegations that his father's generation went on a genocidal rampage to 'kill six million Jews by gassing.' My husband has forensic and documentary evidence disputing these claims. I should also add that my husband financed and paid for his own defence, whereas his adversaries had the taxpayers of Canada and Germany finance theirs. My husband and I met in 1994 and married in 2000. We are mature, responsible people. I am a naturalized citizen of the United States of America. My husband came to live with me on a visitor's visa, but we filed for what is called 'Adjustment of Status' - in other words, permanent residency because he is married to a US citizen. We carefully followed the letter of the law. As required by the INS (Immigration and Naturalization Service), he applied for, and obtained, a Social Security Number. He had himself fingerprinted. He went to have a physical and had himself immunized. He obtained a work permit. He has a valid driver's licence. We own a home in Sevierville (Tennessee). We befriended our neighbours -- all lovely, helpful people who can vouch for our lifestyle. We were weeks away from opening an art gallery because my husband is a sensitive, award-winning artist who looked forward to merging with this community in a peaceful, civically responsible way.

When we applied to INS for 'Adjustment of Status', we received a letter advising us that the paperwork required would take as long as 36 months. We had done all we were required to do. The only thing left was a hearing with an immigration judge who would ascertain that ours was a legal, bona fide marriage. We had one date for such a hearing, June 12, 2001. Our immigration attorney could not make it to this hearing and asked in writing to have this hearing re-scheduled. He never received a reply. After waiting for a year, in May of 2002, he wrote again, asking again to have this hearing re-scheduled, this time with a certified, return-receipt letter. Again, he received no reply. We have copies of these letters, even the date-stamped envelopes. The INS officials claim these letters never reached them. Do they still exist in the INS files? Were they stolen? Were they destroyed? Were they lost due to clerical sloppiness? We don't know. We know that nobody warned us that, allegedly, our INS application had lapsed. We had no way of knowing. On February 5, without any warning of any kind, five government officials appeared, arrested my husband. He asked if he could call his lawyer. He was told that he could not. I asked if I could call our lawyer. I was told that I could not. My husband was frisked like a common criminal, put in handcuffs and led away. He was thrown into maximum 23 hour detention in Blount County Jail. Not one government official saw fit to give me a call and explain. Not one INS officer has talked to me about this kidnapping of a law-abiding man with the help of government officials. We have not been able to get a judge to hear our case and determine what happened on the basis of the evidence we have. Two days ago I found out that a judge has signed an order barring my husband from returning to the United States for 20 years. For what? For having missed a hearing before an immigration judge that INS never saw fit to schedule? I now find out that it was not a 'criminal' arrest -- that it was, as it is euphemistically called, a "civil" arrest. There was nothing civil about this arrest. It was a terrifying, frightening experience."

On February 19, Mr. Zundel was deported to Canada. As a landed immigrant, he could return. However, new regulations cancel landed immigrant status if one has been out of the country for three of the past five years. Zundel's case is borderline. In a hearing, February 24, an immigration officer rejected Zundel's move to return as a landed immigrant, insisting that he'd lost this status. Zundel has filed a refugee claim, but remains in prison, as CSIS in 1996, issued a certificate declaring him a threat to national security. This ludicrous abuse of power may prevent even the acceptance for adjudication of his refugee claim. The 1996 CSIS case could show no acts of violence or breaches of the law on Zundel's part. The case revolved around the assertion that this non-violent man, "might" influence some of his followers to violence. Since Zundel's return, there has been a vitriolic response from the Canadian political establishment and media. The Globe and Mail (February 21, 2003) editorialized: "If Mr. Zundel seeks permanent residency, this country should fight it. If he seeks refugee status, it should promptly deport him, when, inevitably, he loses." A Globe (February 25, 2003)) cartoon showed a pinprick at the centre of the earth as a homeland for Ernst Zundel. As part of the anti-Zundel hype, the Globe and Mail (February 21, 2003) featured a story entitled "Death camp survivor angry at federal law." One Max Eisen said Zundel's refugee claim is "like opening up an old wound all over again ... Don't allow a hatemonger into this country."Predictably, the National Post, the ultra-Zionist flagship of Israel Asper's press empire weighed in with an article based on a "secret" CSIS report suggesting some huge coalition between rightwingers and Moslem radicals. (National Post, February 21, 2003).

Immigration Minister Denis Coderre, echoing the comment of another Montreal would-be gunslinger Pierre Trudeau, said "Just watch me," when asked what he proposed to do about Ernst Zundel. "Those who would abuse the system should watch out for the consequences. And if that [sic]occurs, I will make the decisions necessary to ensure the system is not abused," he threatened. (Globe and Mail, February 21, 2003) Were the fatuous Coderre sincere about abuse of the "refugee" system, he would introduce a "notwithstanding" resolution in the House of Commons to overturn the Supreme Court's 1985 Singh Decision which ushered in the absurdity of people flying into Canada and self-designating themselves as refugees. Actually, Ernst Zundel has a very plausible case for refugee status. He does have a more than reasonable fear of persecution for the non-violent expression of his political, cultural, religious or ethnic views in Germany. Canada has no equivalent of the draconian laws which would jail Mr. Zundel for up to five years for expressing his dissent from the establishment's historical account of World War II.

Needless to say, the League for Human Rights of B'nai Brith and the Canadian Jewish Congress have outdone themselves in demanding that the politicians deport Zundel to Germany. "'It is our position that Mr. Zundel is inadmissible under Canadian immigration laws,' stated David Matas, Senior Legal Counsel for B'nai Brith Canada in a letter sent to the Minister today. 'It would be a disgrace to allow Zundel, a long time hate promoter and Holocaust denier, to re-enter Canada.'" (B'nai Brith press release, February 10, 2003)

It is vital that you FAX (best) or e-mail or write immigration Minister Denis Coderre IMMEDIATELY to urge him to admit Zundel as a refugee.. Canada admits all manner of dissidents. Immigration rules don't even allow officers to detain liars or those with false documents. Zundel is up front and honest. He should be given shelter as a political dissident. Tonight the Canadian Press (February 28, 2003) reported that Ernst Zundel was denied bail today. The federal government is reduced to the ludicrous position that this pacifist publisher is a "threat to national security" should he be released. Another hearing will be held Friday, March 7 and will be open to the public. One of Canada's leading censorship groups, the Canadian Jewish Congress, frets that the proceedings shouldn't be public, as they will give Zundel publicity.

Thorold, Ont. Ernst Zundel, a Holocaust denier who is seeking refugee status in Canada, will remain in custody for another week in this southern Ontario community.

At a detention review hearing on Friday lawyers for the federal government argued that Ottawa has reason to believe Mr. Zundel is a security concern and should be detained.

The Crown and Mr. Zundel also agreed Friday that future hearings will be open to the public.

The next hearing is expected to be held next Friday.

"On consent of both parties, the Immigration division member decided that Mr. Zundel's matters before the immigration hearing would be public," Charles Hawkins, an Immigration and Refugee Board spokesman, told the CBC on Friday.

The Canadian Jewish Congress has said allowing public scrutiny of Mr. Zundel's efforts to remain in Canada might end up playing right into his hands.

"We have to balance the public's need to know . . . with Ernst Zundel's absolute fetish for publicity and the oxygen that feeds that publicity," Bernie Farber, executive director of the Ontario division of the congress, said earlier this week."

By Juan Mann Let's state the obviousÃ¢â¬âthe federal government isn't good at deporting illegal aliens and criminal alien residents.

But it's very good at deporting certain aliens. Thus the young Cuban refugee Elian Gonzalez managed to survive shark-infested waters alone on the way to Florida. But he was no match for the full weight of the Department of Justice, then-Attorney General Janet Reno and the former INS. Little Elian was sent back in Cuba in no time.

His fellow countryman Orlando "El Duque" Hernandez also arrived by sea. But he went on to pitch for the Yankees in the World Series.

Recently, the INS made short work of deporting the extremely politically-incorrect Ernst ZÃÂ¼ndel, a German citizen who calls himself a Holocaust Revisionist and whom his enemies call a Holocaust-denier. Zundel is married to a U.S. citizen and had applied for legal permanent residence. He was arrested on February 5 at his home in Pigeon Forge, Tennessee, and taken into INS custody. He had allegedly overstayed his visa and failed to appear for a deportation hearing.

The Zundels say he was never notified, and he certainly had every incentive to comply with U.S. law. But he was deported anyway and sent to a Canadian jail Ã¢â¬â he was once a Canadian resident - pending deportation to Germany, where his opinions are punishable by jail. The whole process took less than three weeks.

Remarkable, considering the huge deportation abyss of the Immigration Court system - and the normal likelihood of relief due to marriage to an American citizen.

The ZÃÂ¼ndel case shows that the feds can deport aliens - when they set their mind to it.

But they just don't set their mind to it very often. As Michelle Malkin searingly documented in her best-selling book Invasion, the former INS deported illegal alien Rafael Resendez-Ramirez many times - but all unfortunately without spotting that he was wanted for a serial killing spree. Oops.

In the ongoing saga of smuggled Chinese entering the United States illegally, only a few aliens passing through the Snake Road ever face deportation. The exception that proves the rule: those unlucky enough to have traveled on the Golden Venture freighter that suffered a well-publicized beaching in New York City are still here, in legal limbo, after ten years in the Immigration Court system. Many were detained in INS custody for years.

Future Beltway sniper terrorist Lee Boyd Malvo and his mother Uma James weren't kicked out of the country under the Immigration Act's section 235(b) stowaway category. They were released from INS custody so they could attend future Immigration Court hearings. As it turned out, of course, young Malvo had other plans besides going back to Seattle for court.

Almost everyone agrees that the federal government should be deporting more terrorists. But, thanks to the delays of the Immigration Court system, deportation wasn't anything like imminent for at least these infamous five terrorists when they committed their crimes: Gazi Ibrahim Abu Mezer, Mir Aimal Kansi, Abdel Hakim Tizegha, Ahmed Ajaj and Ramzi Yousef.

Out-of-control illegal alien street gang members and murderers also manage to evade deportation. The violent illegal alien Ingmar Guandique wasn't deported. He went on to become a suspect in the murder of Washington D.C. intern Chandra Levy.

The illegal alien gang rapists of Queens, New York - formerly known as "Mexican immigrants" - weren't deported soon enough. Instead they were safe Ã¢â¬â quite possibly because New York City has declared itself a sanctuary for illegals.

Joseph A. D'Agostino of Human Events has reported that the former INS only deported one percent of all illegal aliens in the country Ã¢â¬â who may total as many as 11 million. But it looks like that one percent doesn't include too many Somalis, Iraqis or their alien smugglers.

In the federal Ninth Circuit, at least, gay Mexican transvestites aren't going to be deported any time soon either.

According to the former INS' statistical yearbook, the federal government removed 184,775 illegal aliens and criminal alien residents in the year 2000. But over 800,000 illegal aliens were entering the country illegally every year during the late 1990s. Not much of a track record there.

Who will be the next famous illegal alien to be deported? Will the federal government remove Jesus Apodaca, former pin-up boy in the Denver Post's campaign to get in-state tuition discounts for illegal aliens? Or the parents of Jesica Santillan, who smuggled her in to get a heart-lung transplant, ultimately at taxpayer expense? Don't hold your breath.

But the point is this: the new Department of Homeland Security does have the power to deport any illegal alien it wants. It simply has to summon the will.

Our first victory came when we drove the CTV poll off the air after it went past 45% on behalf of fair justice for Ernst. The second victory came right on its heels when the CNN poll fared just as well in our favor - again it was pulled when it almost reached 50%.

And now this!

For the third time in just a few days we have mobilized decent folks on the Net to help us speak out and, so at least we hope, begin to rectify the brutal injustice of Ernst Zundel's arrest at the behest of the Holocaust Lobby.

Before anything else, let me thank those of you who signed the petition I asked you to sign in yesterday's ZGram. We are at almost 1,000 signatures, at which point we will download the petition and send it to the powers-that-be. Once again, we have beaten our enemies by our quick action. ONLY TODAY did the Canadian Wiesenthalers get around to putting up a petition of their own!

There is a new development of which I only learned today. But before I comment on the two amazing Wiesenthal pieces below, please take note of the attachment. It is an email list of major media, free speech organizations, columnists, first amendment groups, individual conservative writers and activists. It took me days to compile that list, and I urge you to use it with discretion. By that I mean - don't spam! Use it judiciously! One small chunk at a time! :)

What should you write? I have a few suggestions. Compose a brief exposÃÂ© of how American INS officials and law enforcement people were USED by nefarious powers to act as hit squads to kidnap a politically incorrect activist under the guise of the flimsiest of excuses - a "missed" INS interview and "overstaying his visa"!

Include the following:

_ Neither Ernst nor I were allowed to call an attorney when Ernst was told five officials had come to arrest him -

_ Ernst was taken away in handcuffs and thrown into maximum detention even though it was called a "civil" arrest - that is, without an arrest warrant -

_ Upon deportation to Canada, Ernst was handed an order by INS officials barring him for 20 (!) years from the US -

_ Now Ernst is still languishing in maximum security in Canada, facing a warmed-over charge of being a "security risk to Canada"- a country where he has lived for 42 years as a scrupulously law-abiding citizen.

And who is bringing the charge? A sort of Canadian Mossad called CSIS (Canadian Security Intelligence Service) - a civilian spy agency that had full knowledge of a parcel bomb sent to assassinate Ernst in 1995. (!)

How did CSIS know that a parcel bomb was in the mail?

Why did CSIS not see fit to warn not only Ernst but passengers on Canada Air carrying this parcel bomb?

Why did CSIS not warn postal workers who handled the parcel? CSIS DID warn their own undercover agent - does that not tell us something?

Ask media to follow this story. Ask interested persons to read up on it and inform themselves on how "legal" power can be abused.

Now to a new development that, frankly, mystifies me. After having spent years, even decades, trying to get Ernst deported to Germany where he would face long incarceration for challenging the orthodox Holocaust yarn, what do the people with a rubberband conscience now do? They advocate that Germany "suspend" the arrest warrant!

What do you say to that? Do they just want to ship him there - and then do one of their switcheroos and shriek that Germany should throw Ernst in the slammer?

Here are two letters I pulled from the Canadian Wiesenthal web page. I don't know about you, but to me they spell fear of what Ernst will reveal once again if he is handed yet another battle in yet another court - either in Canada or, worse for our enemies, in Germany.

Of all the ironies: After they brutally caused him to be kidnapped, they don't know what to do with him. Tar baby all over again - the more that they struggle, the "stucker" they get!.

Read on! Marvel at their Talmudic gyrations! Watch them twist in the media hurricane that is of their own making - and hold your breath at what might well come next!

Dear Ministers;

On February 20, 2003 I sent you a letter in which I emphasized that Mr. Zundel not be given the opportunity to cause racial discord in Canada.

However, before he could be sent out of Canada, Mr. Zundel was able to file an application, seeking asylum from German justice. This was most unfortunate, as we all know the legal manoeuvring which could result in a protracted stay in Canada by Mr. Zundel.

Even the attempt to have him declared a security risk carries with it the possibility of lengthy court battles.

Each of these options; whether it be an asylum hearing or a security enquiry, increases the likelihood of him arguing that his "political / social" views and freedom of expression are being stunted. Media coverage will be intense and will give Mr. Zundel a golden opportunity to further expound his beliefs, thereby allowing him to commit the very effrontery that Canada and Germany are hoping to prevent.

With that in mind, I wrote to the German Ambassador to Canada (see attached letter), suggesting that Germany suspend any legal action against Mr. Zundel for his past misdeeds. The end result is that there would be no legal basis for a refugee / asylum hearing and no necessity for a national security court case. Indeed, he wouldn't even qualify to stay in Canada upon humanitarian grounds.

Mr. Zundel, being otherwise ineligible to enter Canada, could easily then be expelled to wherever he would be legally admitted, whether that be Germany or elsewhere.

After writing to the German Ambassador, I was able to secure a meeting with a top official in the Embassy. I was advised that our proposal had already been sent to the proper authorities in Berlin. Furthermore, after discussing the matter at length and explaining the reasoning behind it, I was assured that this would be given serious consideration. As well, it was believed that a similar request from Canada would give this suggestion much-needed impetus.

Mr. Ministers, the last thing that anybody (except Mr. Zundel) wants is a protracted, media-hyped series of court appearances which serve to publicize Mr. Zundel. Neither Canada nor Germany ought to squander precious resources on Mr. Zundel. I believe that the same result (the expulsion of Mr. Zundel from Canada) can be achieved in the manner I suggested in my letter to the German Ambassador.

As I pointed out, the sweetest justice would be to show Mr. Zundel a form of mercy that leaves his future in his hands, rather than allowing him to become a self-styled martyr for his cause.

I look forward to hearing from you as soon as possible. Delay only plays into Mr. Zundel's hands.

Dear Mr. Ambassador;

I am certain that the name Ernst Zundel is quite familiar to you.

I am equally certain that you are aware of Mr. Zundel s claim that he ought to be granted asylum in Canada because of (now quite old) allegations that are outstanding against him in Germany.

Needless to say, Mr. Zundel s arguments are patently specious and we are confident that they will be shown to be so at any refugee or asylum hearing that he may have before Canada's Tribunals.

That, though, is precisely the problem.

Mr. Zundel aims to use our judicial system to thwart Germany s judicial system. The fact that (we believe) he will ultimately fail does not, however, solve this quandary.

The issue, as we see it, is, how do we prevent Mr. Zundel from abusing our courts and how can we stop him from using them as a platform to spew his philosophy and thereby attract even more attention to him and his cause?

The answer, I believe, rests within your nation's grasp.

If Germany were to announce that they would suspend any legal prosecutions or actions that Mr. Zundel currently faces for his past activities, then there would be no foundation for his claim for asylum and he would be obliged to go to Germany.

Mr. Ambassador, Friends of Simon Wiesenthal Center for Holocaust Studies and all Canadians have a deep regard for Germany s legal system. But we also believe that German justice has the ability to be not only just and compassionate, but also innovative and inventive.

Therefore, while Germany s decision would open the way for Mr. Zundel s return to Germany, we are confident that your country can easily enforce your laws, if need be. Once there, as long as Mr. Zundel obeys the law, he would remain a free man. If he chooses to break the law then, of course, like anyone else, he could be prosecuted for what he now does. Thus, Mr. Zundel would be completely responsible for whatever happens to him in the future.

We are asking you to forward this letter to the Federal Minister of Justice. Her quick announcement that Germany will not prosecute Mr. Zundel for past misdeeds will succeed in simultaneously depriving Mr. Zundel of an opportunity to exploit the present situation, while highlighting the ingenuity and flexibility of Germany s justice system.

Mr. Ambassador, I will call you shortly to discuss this matter further. I also look forward to the opportunity to meet with you in order to assure you that our 40,000 members believe that the sweetest justice would be to show Mr. Zundel a form of mercy that leaves his future in his hands, rather than allowing him to become a self-styled martyr for his cause.

A human rights group has asked the Canadian and German governments to work together to suspend German charges against Holocaust denier Ernst Zundel because it would enable his "swift removal" from Canada.

"Ernst Zundel hurts people," Leo Adler of the Friends of Simon Wiesenthal Center said today.

"He is a hate monger who uses and abuses the press and the judicial system, and he causes pain and suffering to the survivors of the Holocaust when he says the Holocaust never happened," Adler told a news conference. "Every day he continues to remain in Canada, he continues to inflict pain as he uses and abuses the judicial system."

Zundel, who is seeking refugee status, is in a Niagara Detention Centre awaiting an immigration hearing.

If deported to Germany, Zundel would face charges of suspicion of incitement of hate. The charges stem from material on his Web site that denies that the murder of six million Jews by the Nazis during the Second World War ever took place.

Adler said he has written a letter to Canada's ambassador to Germany saying that a suspension of charges in Germany against Zundel would remove any foundation for his claim of refugee status and would enable his swift removal from Canada.

He also said he has been told by Berlin officials that if Canada worked with Germany, suspending the charges might be more of a possibility.

Zundel was arrested Feb. 3 at his Tennessee home for overstaying a visitor's visa, and returned Feb. 19 to Canada Ã¢â¬â where he was a resident for some 40 years.

Zundel, who held permanent resident status in Canada, became known in the 1980s for staging stunts like strapping himself to a crucifix to get across his Holocaust denial messages.

Holocaust denier Ernst Zundel will remain in jail pending an immigration hearing because the government believes he would continue to spread his anti-Semitic views if released, an Immigration and Refugee Board member ruled Tuesday.

"There are reasonable grounds to believe that Mr. Zundel would be in a position to influence his following,'' said Robert Murrant.

Earlier, a federal government lawyer argued that Zundel would continue to "flout the law'' if he was released from jail and would spread "a call to arms for like-minded individuals to use violence."

"Mr. Zundel is very much a danger to the public, given that he incites hatred," David MacIntosh told the board.

Zundel, 64, is seeking refugee status after being returned to Canada by U.S. authorities for overstaying a U.S. visitor's visa. A German-born Canadian resident for some 40 years until 2001, he has been held in a Thorold, Ont., detention centre near Niagara Falls since Feb. 19.

MacIntosh told the hearing that Zundel flouted American law by failing to appear at a U.S. immigration hearing in 2001, and that he continues to disregard a Canadian Human Rights Commission ruling that his Web site spreads hatred.

Zundel, dressed in the clothes he was arrested in rather than the orange prison overalls he wore Monday, told the hearing that he has no control over the Web site, which is still operational and administered by his American wife.

"I'm a total computer illiterate,'' he told the hearing.

Paul Fromm, the director of the Canadian Association for Free Expression, represented Zundel at the hearing and said his detention was a violation of the Charter of Rights.

Fromm told the hearing that the only writing utensil Zundel has access to is a short, stubby pencil. Holding the pencil up for all to see, Fromm added that such treatment borders on "cruel and unusual punishment."

Zundel said earlier Tuesday that poor legal advice from an American lawyer is the reason he's appearing before the Canadian immigration hearing.

He said that he intended to convert the visitor's visa to a permanent one so he could live with his American wife and missed a required hearing only because his lawyer told him it was "a matter of routine.

"I was happy to have escaped this persecution,'' Zundel said, referring to the media attention and legal troubles he has experienced in Canada.

He said it was never his intention to evade U.S. immigration authorities.

"I did everything that a person could possibly do,'' said Zundel.

About 10 of his supporters attended the quasi-judicial hearing, joking with Zundel about his bright yellow suspenders that resembled a measuring tape before the hearing began.

Federal government lawyers MacIntosh and Toby Hoffman are arguing Zundel shouldn't be released because the government is taking necessary steps to inquire into a reasonable suspicion that he is inadmissible on the grounds of national security.

CSIS official Dave Stewart, the lone witness for the government, testified Monday that Zundel can be considered a white supremacist leader.

"Mr. Zundel is a lightning rod for individuals who believe in the neo-Nazi white supremacist philosophy,'' Stewart said. "He sows the seeds and other people build on that.''

Zundel moved to Tennessee in 2001 in the middle of a human rights tribunal hearing about the content of his anti-Semitic Web site, angrily denouncing Canada's attempts to silence his views.

He was convicted in the early 1990s of breaking Germany's anti-hate laws and fined $9,000. There also is an outstanding warrant for his arrest on suspicion of incitement of hate, stemming from his Web site.

Dear Free Speech Supporter:

Here's my brief report on the two-day detention hearing for Ernst Zundel, held March 31 and April 1. Two lawyers had quit on Ernst Zundel. I was asked by supporters, consistent with our mandate to fight for free speech, to act as Mr. Zundel's legal representative at these hearings.

Just to recap. Ernst Zundel, a German-born revisionist publisher, had left Canada in 2000 and taken up residence in Sevierville, Tennessee with his American wife Ingrid Rimland. On February 5, INS agents arrested him for alleged violations, including failure to attend a hearing. This situation is very complex. It appears that his then lawyer may have made errors or let him down. Mr. Zundel is scrupulous about obligations and legal matters and always sought to fulfill every requirement.

With unseemly haste, he was ordered deported and banned from the U.S. for 20 years. He was returned to Canada.

Our Minister of Immigration Denis Coderre who has seldom met a "refugee" claimant he didn't like snorted and roared. "Just watch me," he threatened, emulating Pierre Trudeau vow to get the FLQ. The absurd Coderre, already prejudging the Zundel case, said no one would make a mockery of our refugee system. Well, that's already been done by him and his department.

Mr. Zundel, since 1958, had been a landed immigrant. New changes in the law decreed that if one was absent from Canada for three years in five, one lost "landed immigrant status." At his first hearing, Mr. Zundel was informed that he was no longer considered a "landed immigrant." This decision is under appeal.

His only remaining recourse was to claim "refugee" status based on a well-founded fear of persecution should he be returned to Germany. The Germans have issued a request for his extradition to face "hate" charges under a system where truth is no defence and where a fierce and punitive fine and up to five years in prison await him.

On Monday, March 31, I arrived at the Niagara Falls, Ontario Immigration Offices where the hearing would be held. Nearly 20 supporters from around Southern Ontario and from as far away as Alabama gathered to support the prisoner of conscience.

After numerous inquiries, I was told that "the prisoner" had arrived. I was ushered into a small holding cell. There was Ernst Zundel, unshaven, wearing a humiliating pumpkin orange prison jumpsuit. Worst of all, he was in leg irons. A shame-faced guard removed them as we began to discuss the case. I had less than 20 minutes to be briefed as to what he wanted. I did have material prepared in advance by several supporters.

I was accompanied by Wolfgang Mueller my CAFE colleague. He and I had strategized about the case and he would help with translation of some of the German documents pertinent to the file.

As we entered the hearing, a swarm of media surrounded Ernst -- CTV, CBC, radio and numerous print outlets, including the TORONTO STAR, THE HAMILTON SPECTATOR, THE ST. CATHARINES STANDARD, THE NIAGARA FALL REVIEW, and the Canadian Press, oh yes, and THE CANADIAN JEWISH NEWS.

On the other side were no less than three government lawyers. Normally, a slim mild-mannered man named Bill Reid handles these cases. As he explained to me, he's not even a lawyer. So, if you're a Jamaican drug dealer or gunman who's been ordered deported and are caught trying to sneak in, or, if you're a Tibetan asylum shopper coughing up multi-drug resistant TB, you face Bill Reid.

However, if you're a 64 year old pacifist, a Revisionist publisher and publicist for unpopular views, then you face the A Team, the Department of Justice's Dream Team. Heading the taxpayers' anti-free speech hit squad was Donald MacIntosh. The government brought him in specially to face Mr. Zundel. MacIntosh is one of their heavy hitters in war crimes cases. The assignment seemed odd, as Ernst Zundel was all of 6 years old when the war ended in 1945 and even his most fanciful and inventive foes haven't accused him of war crimes.

MacIntosh, thin, inordinately pale, sports long shaggy grey hair and would screw up his face into a grimace when questioning Mr. Zundel.

The Immigration and Refugee Board adjudicator was Robert Murrant. In his opening remarks, he made it clear that he would first like to hear submissions about 58.1.c of the Immigration and Refugee Protection Act. Section 58.1 says that a person in custody under the Act shall be released, unless the adjudicator is satisfied © "that the Minister is taking necessary steps to inquire into a reasonable suspicion that they [sic] are inadmissible on grounds of security." He, then, proposed a definition that all but guaranteed the Crown victory. As he saw it, these words meant that 1. he had to be assured that CSIS was undertaking an investigation for the Minister of Immigration and that, 2., the Minister said he had a reasonable suspicion that the detained person was a threat to national security.

We also learned that Murrant had attended an in camera hearing in Ottawa on March 25. This secret briefing by CSIS is part of the Court of the Star Chamber proceedings that have been used against Ernst Zundel. I strongly objected that such secret hearing, where we had no opportunity to confront the witness or even know what was said, violated the basic guarantees of Anglo-Saxon justice and Common Law; that the accused has the right to face his accusers.

MacIntosh retorted that the Supreme Court endorsed such secret testimony in its judgement in the Chiarelli case. Actually, in that judgement the Supreme Court upheld Section 48.2 of the CSIS Act that can exclude the accused from portions of a hearing. However, the Court noted: "The CSIS Act ... recognizes the competing individual and state interests and attempts to find a reasonable balance. ... Although the first day of the hearing was conducted in camera, the respondent was provided with a summary of the evidence presented." It must be noted that the evidence in the Chiarelli case involved drug trafficking and murder.

Ernst Zundel's case involves the promulgation of ideas, not the peddling of drugs or the commission of murder, I argued.

The first and only witness against Ernst Zundel was CSIS agent David Stewart. Stewart indicated that CSIS was preparing a report for Immigration Minister Denis Coderre was to whether Ernst Zundel constitutes a threat to national security.

Stewart was then questioned on a four-page report, which he said he hadn't written, but on which he could comment. This report is more an ideological rant, more in keeping with a press statement from B'nai Brith or an ARA screed than a balanced intelligence report. It is filled with repeated use of smear words -- "neo-Nazi", "White supremacist", "anti-Semite."

For all the alleged investigation that had been done into Ernst Zundel, the report is based on two ancient media reports: a March 25, 1981 TORONTO STAR story about raids on rightist homes in Germany that turned up literature supplied by Ernst Zundel; and a 1993 CBC "Fifth Estate" programme linking Ernst Zundel to various right-wing groups in Germany. He was alleged to have sent them money to distribute literature and organize protests and to have supplied them with literature.

Stewart's appearance at the witness table was heralded by a demand that no photos be taken of him for "security" reasons. Because of his delicate job, MacIntosh alleged, Stewart's "personal safety" might be in danger. I strongly objected that this melodrama was injurious to Ernst Zundel, leaving the impression that somehow he or his supporters might taken vengeance on the CSIS agent. Dark hints that one's very life in jeopardy is a common tactic of anti-racist campaigners. Both Warren Kinsella and Alan Dutton of the Canadian Anti-Racism Education and Research Society have spread it about that their lives are in danger from the far right. The joke of it is that it's people like Ernst Zundel who've been on the receiving end of assaults and firebombings, not state agents like Stewart or grant-catchers like Dutton. Murrant, of course, ordered that the brave CSIS snoop not be photographed.

After brief testimony, Stewart, slim, witrh a typical tightly trimmed cop moustache was mine for cross-examination. I asked him to go over the definition of a threat to national security. The CSIS Act makes it clear that threats to national security include espionage, activities directed by a foreign state, attempts to violently overthrow the government of Canada or "the threat of use of acts of serious violence against persons or property for the purpose of achieving a political, religious or ideological objective within Canada or a foreign state." I then had him read the special warning Parliament included in the legislation, as it sought to avoid the creation of a political police that would target non-violent opponents of the government of the day or of the powerful groups that back it. He read: A threat to national security "does not include lawful advocacy, protest or dissent."

"Then, what is Ernst Zundel doing in your report?" I demanded. The main allegations were that Zundel "was viewed as the patriarch or leader of the White supremacist movement in Canada; was and still is a leading distributor of revisionist neo-Nazi propaganda world-wide, [and] ... maintained White supremacist contacts internationally and channelled money through these contacts to promote his cause."

Even if all these accusations were true -- and we deny many of them -- how would any of this fit the definition of "national security?" I asked. Immediately MacIntosh was on his feet. Stewart, he argued, was not a legal expert and could not give a legal opinion. Suddenly, it seemed Stewart wasn't much of an expert on anything. He hadn't read the report and couldn't or wouldn't report in any detail on the Zundel file.

Perhaps, he's not a legal expert, but he and CSIS are supposed to operate with the law, I insisted. "Do Zundel's activities even fall within the CSIS mandate? Are they not, if fact, simply non-violent protest and dissent? I was thwarted in my pursuit of this vital information.

I then asked Stewart about some of the inflammatory labels. "Would Ernst Zundel," for instance, "describe himself as a White supremacist?" Stewart didn't know. I then questioned him as to whether he knew the disposition of the charges arising from the raids of 1981 -- the subject of the sensationalist article that formed part of the report. Stewart said he did not. Our CSIS expert cannot have done his homework. In the detention hearing of February 28, Ernst Zundel asked the same question and received the same answer. And, yet, CSIS is supposedly actively inquiring into whether or not Zundel is a threat to national security.

In his testimony, Stewart said that the White supremacist movement had been in decline since 1994. Zundel's return would serve as a lightning rod perhaps to revive the movement. "But wasn't Ernst Zundel in Canada until 2000 and in this six years somehow his presence didn't revive the movement?" I was being stonewalled. "Isn't 1994 significant because that was the year CSIS agent and financial sugar daddy Grant Bristow was exposed as a leading member of the Heritage Front?" Objections from MacIntosh ensured that I never received a complete answer to this question.

While Stewart asserted that he hadn't written the report, he did admit to having edited it. The "Summary Report Concerning Ernst Christof Friedrich Zundel" presented at this hearing was different in some ways from a similar document presented at the February 28 hearing. If anything, if was even more inflammatory and filled with invective. One comical error in the earlier report spoke of "Zundel's battle for the New World Order." The new improved report more accurately describes his "battle against the New World Order." Was the error a momentary lapse on the part of the eagle-eyed and apparently anonymous CSIS writer? Or? We know that Ernst Zundel and a legal representative spoke about this nonsensical statement over the prison phone.

Thus, I asked Stewart as my final question: "Was this change the result of new information or of CSIS listening in on Mr. Zundel's telephone calls?" MacIntosh was on his feet objecting furiously. "I thought you might," I concluded.

Now, it was our turn. I called two witnesses, Karin Kruger and Gerhard Haas. Miss Kruger testified that she was prepared to offer her house as a surety for bail or guarantee for Ernst Zundel. She'd done this in earlier trials he faced. Hr. Haas indicated that he'd provide a lodging for Mr. Zundel when he's released.

We were now at the dramatic moment. Ernst Zundel, dressed in his prison garbs, took the stand. He tore the four page report apart. He went through his 20 year battle with the Canadian legal system. He had always worked within the system. He'd fulfilled all his many bail conditions and faithfully attended at all court appearances where he was required. Ernst explained that he had first come to Canada to avoid military service and explained that he was a pacifist. He had thrown people out of his home for loose talk about violence. He indignantly refuted the allegation of "White Supremacy" pointing out that he'd hired no-White and had sheltered a Jamaican survivor of the Waco massacre for over seven months.

Mr. Zundel explained at length his operations in Germany. Yes, he had funded literature distribution and meetings. However, his emphasis was always on education, not violence. His one-time chief public relations mad in Germany Ewald Altans, who was subsequently revealed to be a homosexual working for the German Constitutional Police, had also always shunned violence.

Zundel's testimony was passionate and electrifying.

I next put to his some pages from Andrew Mitrovica's bombshell book COVERT ENTRY: SPIES, LIES AND CRIMES WITHIN CANADA'S SECRET SERVICE. This book, relying on the revelations of former CSIS paid snoop John Farrell, reveals a sordid campaign of mail opening, lewdly named Operation Vulva, directed against "not only the heads of Neo-Nazi organisations in Canada but all 'racists, fascists and anti-Semites.'" (9\p.127) One of their chief targets was Ernst Zundel. His mail was being seized and opened and examined. Zundel testified that he knew of this spying and said further that some of his mail, including divorce papers, had been stolen.

The explosive revelation from the book, however, was that at a certain point Farrell's CSIS handler, an agent named Don Lunau, told him not to touch any packages for Zundel, especially ones from a Vancouver return address. "Farrell's own nervousness peaked when Lunau ordered him to temporarily stop intercepting parcels destined for Zundel's home. ... Lunau wasn't kidding. Farrell could hear the urgency in his voice. In May, 1995, a parcel arrived at Zundel door apparently from a Vancouver post office box. "(P.138-139) it was a pipebomb. "Police said the bomb was packed with enough explosives to seriously maim or kill anyone within 90 metres of the blast."

Had CSIS ever warned him about the bomb they clearly knew was coming. "No" Mr. Zundel answered.

We tendered into evidence a notarized statement from Jurgen Rieger, Mr. Zundel's German lawyer, outlining how, with one minor exception, Zundel has been cleared of all charges and overturned state actions against him, like the seizure on several occasions of his German postal banking account.

Ernst Zundel also confirmed that an Access to Information Request had revealed that he'd been under police surveillance on and off since 1958, when he attended anti-Communist meetings in Montreal.

As our second and final witness, I called Rev. Dr. Robert Countess of Alabama, who has known Mr. Zundel for over 15 years. Rev. Countess is a scholar of Biblical Greek and was for over 20 years a U.S. Army chaplain. He is also a staunch historical revisionist and has become a sort of spiritual counsellor to M. Zundel since his move to the U.S. about three years ago. "Is Ernst Zundel a White supremacist?" I asked Dr. Countess. Countess was emphatic in his testimony that Zundel was not a racist or White supremacist and recounted how Zundel had hugged the orphaned Haitian adopted son of a close friend whose memorial they had both attended.

The evidence in, it was now time for submissions or argumentation. MacIntosh was insistent. He declared he didn't care how high bail was set, Mr. Zundel would fail to comply with bail conditions. He insisted that the government was continuing its investigation into Mr. Zundel as a threat to national security and, therefore, he must remain in prison.

In my submissions, I invited Adjudicator Murrant to consider "the totality" -- a favourite phrase of Mr. MacIntosh -- of the Immigration and Refugee Protection Act. Section 3.3 requires: "This Act is to be construed and applied in a manner that (d) ensures that decisions taken under this Act are consistent with the Canadian Charter of Rights and Freedoms." I urged his to see that 58.1.c meant that the Minister of Immigration must have a "reasonable suspicion" that Ernst Zundel is a threat to national security.

I emphasized that Zundel had been a subject of police investigation for over four decades. While Stewart wouldn't acknowledge how long they'd been investigating Mr. Zundel, he did allow that "he was known to them." For nearly a decade -- 1983 to 1992 -- Ernst Zundel had been before the courts and had operated in a fishbowl. Furthermore, he was a publicist, perhaps even a dramatic self-promoter. He was never shy, whether through press releases, or speeches, or television programmes or video or audiotapes to express his views. "Ernst Zundel is an open book, a known quantity," I said. yet, despite the relentless attacks of his enemies and extensive surveillance, neither in Canada nor in Germany had he ever been charged with an offence involving violence, not assault, not conspiracy to commit assault, not accessory after the fact. Indeed, Ernst Zundel has no criminal record in Canada at all. His views might be unpopular, but questioning one version of World War II, is "dissent",. not a threat to national security. "There are no reasonable grounds to believe that Zundel is a threat to national security."

I pointed out that many of the people who appear before him are illegals with false ID or no ID. There may, indeed, be grounds to hold them pending a national security investigation. Zundel is a public figure, a well known quantity. What's there to investigate?

I pointed out that continued incarceration violated Mr. Zundel's right under 11.d "not to be denied reasonable bail" except in accord with the law. Zundel, under the arcane rules of the Niagara Detention Centre, cannot have a pen. He must try to scribble his defence notes with a tiny stub of pencil. I held up a sample to show Mr. Murrant. In these conditions, he cannot mount a proper defence to the many cases he has going under the Immigration Act and in the U.S. to regain his U.S. immigration visa, I argued.

Furthermore, Mr. Zundel has a track record. He'd received bail on numerous occasions and, to speed up the process, Mr. MacIntosh had agreed that Zundel had attended all the hearings, as required. The same lady was once again prepared to risk her house as a guarantee. Besides with an expired passport and the prospect of 20 years in prison should he sneak back to the U.S., where precisely was Ernst Zundel to go.

Perhaps indelicately, Ernst Zundel had said during his testimony that human rights commission tribunal members and members of other tribunals were party loyalists appointed by the Liberal or Conservative governments of the day. Sadly, this is usually true. I invited Mr. Murrant to defy the wishes of his political masters,. I reminded him that no one remembers the name of the British judge who signed the death sentence of many of the Irish rebels after the failed Easter Rebellion of q1916, but everyone remembered the name of uprising leader Padraic Pearse.

Perhaps it went over his head.

In his rebuttal,. MacIntosh broke new legal ground. As he sees it, national security means whatever we want it to mean. "The law is a textured and complex instrument. The CSIS Act is only the starting point to what constitutes a threat to national security," he said.

Murrant kept us in suspense. At 3:30, he told us he'd be back with a decision in 45 minutes or with the announcement of when he'd have the decision. He returned to say he'd need more time. At 5:30, we returned to the hearing to learn Ernst Zundel's fate.

The usual procedure in announcing decisions is to briefly summarize the positions of the two sides and then explain the judgement. The Crown evidence was summarized and then agreed with entirely. Our arguments were not just ignored, they were not even acknowledged. We might just as well have spoken in Tagalog without a translator.

Murrant said: "Mr. Stewart testified that CSIS along with the Citizsnship and Immigration Commission are in the process of compiling a report that will be presented to the Minister. Because of the volume of material involved, it is not yet complete. I am satisfied that the Minister is taking steps to inquire into his reasonable suspicion. Is there a reasonable suspicion that Mr. Zundel is inadmissible because of reasons of security. The test of reasonable suspicion is quite low. It is less than reasonable and probable grounds, less than a balance of probabilities." He indicated that the Minister indicating he had a "concern" would be sufficient to be "reasonable". The test here is: Is the Minister taking reasonable steps to inquire,

I'm ordering the continued detention of Ernst Zundel. I intend to set the next detention review for May 2, 2003.

Several tearful supporters hugged Ernst Zundel. The prison officials seemed ashamed and allowed him a little extra time with his friends and his spiritual counsellor Rev. Dr. Robert Countess.

As he was led away, Ernst Zundel said: "I am the last German soldier of World War II."

If there's any one thing that most clearly reveals the Jew character this is it.

These are the people who whine endlessly about their own past persecutions, real and imagined, and yet they will happily destroy the life of anybody who dares to express opinions about historical events that might, just might, shed some light on the Jewish eternal reparations for victimhood scam. They brag endlessly about their own commitment to and participation in the "civil rights" movement but when the goys are gone they smirk and pat each other on the back as they contemplate Zundel rotting in jail. And you won't find more than one Jew in a hundred that thinks Zundel and everybody like him shouldn't be punished for their thought crimes. Yes, what fine examples of humanity...

Here is an update on Ernst Zundel's illegal imprisonment by the Canadian government, taken in part from our regular Power Letter to supporters:

As you will remember, there is going to be another immigration hearing on Friday, May 2nd. This time, Ernst will have legal representation - something that was difficult to attain previously since there seems to have been a concerted telephone campaign by his detractors, meant to intimidate and perhaps even terrorize any legal firm or individual attorney who was contemplating taking Ernst on as a client. This was backed up by some vicious media - and I mean, really vicious! And, sad to say, it worked!

All of us who know, respect and love Ernst Zundel have worked day and night behind the scenes, and I am glad to say, prospects are slowly changing in his favor.

For a start, there will be some picketing by Zundel supporters at the hearing this Friday. If you are free and in the area, consider joining. For further information, go to the Zundelsite, www.zundelsite.org

If you are not in the area, you can still help. Write, fax or email to the Immigration Minister. Remember, he's the one who thought nothing of prejudging this case - he is the one who threatened, to please the Shrill Minority, that he would see to it that Ernst would not be allowed to stay in Canada and would, instead, be deported. His exact words were: "Watch me!" Not biased in the least - right?

So write him, and give him a piece of your mind. No need to be lengthy. Be classy. Be clear and to the point!

We have two carefully researched legal actions initiated in the United States. We are feverishly involved in exploring half a dozen other avenues to bring relief to Ernst. We have spent a lot of money already, and huge bills are looming, but the brutal truth we cannot afford to ignore is that Ernst is still being held in maximum detention in Thorold, a small town near Toronto. It's now been more than two months since his unlawful arrest and the subsequent leg irons and other restrictions - and I still can't quite believe what happened, given that he was guilty of nothing!

He wrote to me, referring to the bizarre claim on the flimsiest of "evidence" that he is a "security risk":

**They claim that falsely, but they have made their claim stick so far, that I am in fact "an enemy of the state of Canada" - so "dangerous" that two guards take me everywhere I have to go. Every half hour, day and night, a guard comes by my cell and looks into this brightly lit cage and then writes down what he sees me do - eat, write, sketchSThat's the new reality for your gentle husband and friend.

The guards here are far more human, polite and professional than they were in that disgusting Blount County Jail, but their orders are, Ingrid, that when I want to take a shower, again two guards have to stand by the locked shower door. I have to call them to unlock the metal door to the shower to lead me back to my cell. Those are their orders, Ingrid my dear wife - it's not their fault that they are cruel; they do their job. Everybody has to follow orders.

If the security chief of this jail needs to see me to discuss something with me, or bring me papers, mail etc., this high-ranking official has to ask the guards on duty to open either my feeding slot or my cell door. I have to endure this until such a time that some Canadian judge or a group of Appeal Court judges end this, for the Jews in CSIS and at the Prime Minister's Office have the power and use the taxpayers' money, as they have always done in my case, to punish me mercilessly because I am a German who will not bow down to their lies about our father's generation.

For the moment, I am in their total control. If the present trend continues, I am working myself into a niche in history like Rudolf Hess. Maybe that's why I always had such empathy for that tragic figure of German history.

I will try my darndest, with all the brain power at my command, to see what I can still do with my reduced possibilities in legal moves and, sad to say, the diminishing legal help at my disposal. Do not be disheartened, my lady, by setbacks, delays, hurts, unfairness and chicanery. Get advice, but decide inside your heart and soul. Thank God we are no longer teenagers - that this crisis has come along at this time in our lives!**

To which a supporter replied:

**I felt I should give you a different perspective on your above thoughts.

Ernst is indeed a threat to the security of Canada, but of course not in the way that the Canadian government stated it. More than that, Ernst is a major threat to the entire New World Order, and the globalist overlords know it.

The main pillar of the New World Order is that the Allies were the forces of good and the Nazis were the forces of evil. Therefore, this triumph of good is the justification for the globalist agenda and the United Nations and all the other international organizations and agreements that flowed from the Allied victory.

The chief "evidence" for this is the alleged Nazi gas chambers. From this follows the Religion of the Holocaust, which is the dominant religion of our day. [This Religion] does not tolerate dissent, and it has transformed Christianity into Christian Zionism.

Ernst's work threatens the main ideological justifications for the New World Order. I do not have to explain why to you. So, in a way that the globalist overlords will not state publicly, Ernst is indeed a major threat to them and their system. They do not dare to state the real reasons why they seized him. They now have him in their grasp, and since they did not capture him by law, they certainly are not going to release him by law. They simply have the power to take him, and they decided that now is the time to do so, precisely because they see him as a threat in the context of their ongoing agenda to remake the world.

Law has nothing to do with it, and therefore a legal defense for Ernst is irrelevant. If the legitimate laws of the United States and Canada were in effect, Ernst would still be in Tennessee. Or better yet, he would be in Canada with Canadian citizenship, never having been forced to leave. But in that case, the New World Order would not exist.**

I replied immediately, arguing that I did not agree, since trying to free Ernst by means of legal strategies is really the only way we can effect a change. We cannot bust him out of jail. The legal way is all we have left, and it is by no means a futile effort. The violation has been so egregious that I cannot imagine an American judge not seeing that something needs to be done - that a man should not have to be locked up in maximum security, be shacked with leg irons and handcuffs, and be prevented from being reunited with his family for 20 years for having "missed" a bureaucratic appointment his attorney had asked to be rescheduled!

I am working with two attorneys here. We are in touch with two other attorneys in Germany. As I alluded to above, Doug Christie, Ernst's long-time Canadian attorney, was able to free himself from his other commitments for a few weeks and is consulting with Ernst in Ontario on our next legal move even as I am putting the final touches on this letter.

I feel we have started to take back control.

Dear Mr. Prime-Minister,

As the representatives of Russian society, let us express our deep concern about Mr. ZundelÃ¢â¬â¢s case unheard of in a civilized world. Zundel's only crime was to question the official version of some minor events of World War and ask who was behind 9/11 (there is no sane person today believing in Mr. BushÃ¢â¬â¢s anecdotes).

If we tolerate that your government deports someone who has been a legal resident for over 40 years and hasn't committed any crime, on purely ideological reasons- this means Canada has nothing to do with democracy at all- being a sort of totalitarian fascist state, and your Ã¢â¬Ånon-interferenceÃ¢â¬Â speaks only of your governmentÃ¢â¬â¢s treacherous attitude towards your own nation.

WeÃ¢â¬â¢d like you to understand, there are people in Russia, Ukraine, Belorussia, Serbia, Bosnia, Greece, Bulgaria and other places of Eastern Europe who will hold Canadian and US authorities wholly liable for that shameful abominable treatment of political prisoner of consciousness and American Refusenik Mr. Zundel- thanks to antisocial cabal laws exercised by irresponsible corrupt lobbied state bodies and agents of foreign financial and political influence.

LetÃ¢â¬â¢s come to the facts:

Ernst Zundel has been kidnapped in the USA in a covert governmental operation involving Canada's political police, CSIS and the United StatesÃ¢â¬â¢ secret services under pretext of catching the Ã¢â¬ÅterroristÃ¢â¬Â, in fact this was no deportation - it was a totally unlawful extradition!

Ernst Zundel has now been kept in a Canadian prison for more than a year, in brutal, degrading conditions in maximum detention, without having been charged, without even the right to know what he has done wrong. CSIS agents have compiled a smear sheet that is the document to do him in. Bail has been denied repeatedly, even though he has no criminal record whatsoever, having lived in Canada for over 40 years before his marriage to a US citizen and moved to the US.

Ernst Zundel is being tried in Toronto by a sole judge. This judge, a former boss of the nefarious CSIS outfit (being a sort of Canada's Mini-Mossad or Mini-KGB) listens to Zundel's accusers in closed session, while Mr. Zundel does not even know who his accusers are or what they say - allegedly because that would endanger "national security"- absolutely the same dubious slang of Soviet CheKa/NKVD !!

In such a Bolshevist/Gulag-style Star Chamber system, a "guilty" verdict becomes a foregone conclusion. Ernst is deprived of any possibility of an appeal - not even the Supreme Court of Canada can nullify the judge's judgment. Such is the "law" in "liberal-democratic" West ! So it seems, in circumstances, Mr. Zundel will be forced to apply to European Court or Hague Tribunal and Amnesty International for crude Human Rights violations practised by both American and Canadian governments.

We demand that Canadian governmental officials responsible for Mr. ZundelÃ¢â¬â¢s insults and tortures, immediately stop ideological terror, resign, publicly repent and compensate to him for all the inflicted atrocities.

Ernst Zundel is a political prisoner being persecuted and prosecuted for no crime other than expressing his views on the Second World War. At the behest of the powerful and vindictive Holocaust Lobby, Mr. Zundel is being held, without bail, in solitary confinement at the Metro West Detention Center . He is being treated worse than a common criminal, denied even the basic amenities provided to other prisoners.

In surreptitious, Star Chamber hearings, held behind closed doors, the Canadian Security Intelligence Service (CSIS), relying on the questionable testimony of highly-politicized government agents, concluded that Mr. Zundel - an avowed pacifist - is a "security threat to Canada ." Mr. Zundel was not allowed to attend, or present evidence in his own defense at these secretive proceedings. He has been denied the right to face his accusers and their accusations.

Mr. Zundel came to Canada in 1958 and by any standards, was the model immigrant and citizen, first putting himself through university in Montreal and later becoming Canada 's premiere graphic artist. His artistry graced the covers of Canada 's top national magazine and his paintings - which invariably reflect his pacifist, nonviolent philosophy - adorn the walls of some of the finest homes in the country. It's very simple: Former Canadian spy agency boss should not be the judge in a case wherein the same spy agency is making the accusations.

LAWYERS FOR Canada's most famous prisoner of conscience, Ernst Zundel, will be in Ottawa tomorrow before the Federal Court of Appeal, seeking a stay (halt) of the proceedings before Mr. Justice Pierre Blais. Peter Lindsay and co-counsel Chi-Kun Shi will be asking for the stay pending an appeal of Judge Blais most recent decision to refuse to recuse himself for the appearance of bias.

Read over these submissions and see the sorry and blatant record of the former CSIS boss Pierre Blais's prejudicial rulings and outrageous comments at the expense of the German-born publisher.

TAKE NOTICE THAT Ernst Zundel will make a motion to this Honourable Court on a day to be assigned by the Registrar at 330 University Avenue, Toronto, Ontario or at a location to be assigned by the Registrar.

THE MOTION IS FOR:

An order staying the Security Certificate Review herein conducted under Court File No. DES-2-03 before the Honourable Mr. Justice Blais pending the outcome of an appeal from the order of Justice Blais dated September 24, 2004 dismissing Mr. Zundel's motion for recusal on the grounds of a reasonable apprehension of bias; and 2. Such further and other relief as this Honourable Court deems just. THE GROUNDS FOR THE MOTION ARE

serious issue

There is currently an outstanding appeal against an order dismissing Mr. Zundel's request for the Honourable Justice Blais, the presiding judge at the security certificate review herein conducted under Court File No. DES-2-03 (the "Review"), to recuse himself due to a reasonable apprehension of bias;
The judicial improprieties and erroneous rulings, all adverse to Mr. Zundel, which lead to such apprehension include the following: (a) serious lack of even-handedness in favour of the Crown, including
allowing the Crown to cross-examine Mr. Zundel on his view on Hitler's view on interracial marriages as an "important question";
allowing the Crown to cross-examine Zundel witness Doug Christie on his view of the truthfulness of Zundel's testimony that Christie has no knowledge of;
disallowing Mr. Zundel's counsel ("Zundel counsel") from asking CSIS to point to a single incident of Zundel inspired violence in unclassified materials;
disallowing questions that address the competence of CSIS in gathering information and its credibility.

(b) patent errors of law and refusal to correct or even acknowledge errors, including

disallowing some of Zundel counsel's cross-examination questions on the basis that the answer may disclose information which "could be" injurious to national security. The correct test is: "would be" injurious to national security pursuant to s. 78(b) of the Act.
Refusal to correct or acknowledge such errors when Zundel counsel pointed them out;
claiming judicial entitlement to dismiss the motion for recusal due to the absence of an affidavit. The motion relied on transcripts. (c) inconsistent and sometimes clearly wrong rulings in the name of "national security", in effect prohibiting Zundel counsel from conducting any meaningful test on Crown materials provided by CSIS, including
insisting that some materials prepared and disseminated by Mr. Zundel may be classified and therefore their use in court accordingly restricted;
disallowing, on the ground of national security, all questions whether CSIS has any unclassified evidence that Zundel was ever involved in any violence or acts or terrorism anywhere. (d) prejudging, including
indicating on January 21, 2004 while Mr. Zundel was in the midst of responding to all Crown allegations, that His Lordship disbelieved Zundel's evidence and was, on the other hand, convinced by secret evidence that Mr. Zundel is actually a danger to national security;
repeatedly commented on the positive credibility of CSIS witness Mr. Dave Stewart during his cross-examination by Zundel counsel;
complained that no progress was being made when Zundel counsel spent time cross-examining CSIS witness about the means through which Zundel allegedly perpetrated violence and endangered our national security. The judicial complaint followed Crown counsel's objection that those questions were a waste of time;
exclaimed to Zundel witness while he was on the stand that his testimony was of no value whatsoever;
before the hearing of the recusal motion herein, where one the remedies sought is that the hearing not proceed until said motion has been decided, Justice Blais made it clear that he would continue the hearing prior to deciding the recusal motion. (e) insult counsel, including comments characterizing Zundel counsel as
playing games, being tricky, trying things that were smart but against the law, wasting time and being nervous;
during one hearing date, Justice Blais so interfered with Zundel counsel's submissions that His Lordship himself felt, after the lunch recess, compelled to apologize for his conduct towards Zundel counsel; (f) excessive interjections during crucial cross-examination by Zundel counsel, including
destroying with aggressive and persistent interjection entire lines of cross-examination by Zundel counsel on CSIS own written admission that Zundel's alleged tool for endangering national security, the white supremacist movement, was itself not a threat to our national security. (g) allowing late Crown objection and subsequent witness change to previous answer to the question, including
CSIS witness changed his answer from "no" to "don't know" regarding any Zundel criminal conviction on aiding and abetting crimes after the Crown objected to the cross-examination question. And assume an adversarial attitude towards Zundel witness and counsel, including
characterizing the recusal motion as Zundel counsel's coercing the court;
characterizing Zundel counsel's conduct as goading His Lordship;
The conduct of the Honourable Justice Blais during the Review to date had been so patently unreasonable and the improprieties so palpable and overriding, that they destroy the underlying fairness and legality of the proceedings. Such conduct cannot be corrected by appeal or judicial review at the end of said Review (because there is no right to launch any final appeal or judicial review on the merits of the findings with respect to the Certificate);
The improprieties of the Honourable Justice Blais are also jurisdictional in nature according to Re: Felderhof in that they constitute (I) gross denial of natural justice; (ii) irreparable judicial violation of constitutional rights; and (iii) prejudgment;
As the Certificate Review process determines whether Mr. Zundel will be deported to a country where he will be jailed for actions that are legal in Canada, it engages Mr. Zundel's s. 7 Charter rights. The process must thus be in accordance with the principles of fundamental justice. It is not in accordance with such principles and the rule of law for Mr. Zundel's fate to be determined by a Court which appears to be biased against him;

irreparable harm

Unless a stay is granted, the Security Certificate Review will continue without Mr. Zundel being able to receive, or appear to receive, a fair hearing;
The evidence in said Review has closed and closing arguments have been scheduled to commence on October 19, 2004 with an estimate of 5 days in total to complete them. Unless a stay is granted NOW, said Review will be completed and, given the appearance of bias and the presiding judge's comment in the middle of the hearing, a quick order upholding the Security Certificate appear to be a certainty;
Such order will serve as a removal order pursuant to the Act. Said removal order is unappealable and is not subject to judicial review. It is enforceable without the necessity of holding or continuing an examination or an admissibility hearing and the Applicant may not apply for protection from the Minister of Citizenship and Immigration;
Germany, the Applicant's birthplace, has offered to "pick up" the Applicant at short notice and pay for his deportation back to Germany;
Germany has also indicated that, if deported to Germany, the Applicant will likely face lengthy jail term for denying the Holocaust, which is not illegal in Canada;
Unless this Honourable Court grants a stay, such jurisdictional errors will continue and the appearance of a "rigged court" will remain with, in effect, the tacit tolerance of this Honourable Court. In the meantime, Mr. Zundel may be deported to Germany and the issue as to whether "justice appears to be done" in this case will become moot and buried;
Unless a judicial body independent from Justice Blais reviews and adjudicates the propriety of the judicial conduct at issue fully, it remains for posterity as a stain on our judicial system and on all courts, including this Honourable Court, which has the opportunity to conduct such review NOW;

balance of convenience

Mr. Zundel has been ordered by the designated judge on September 22, 2004 to remain in custody. Therefore, should a stay be granted, Mr. Zundel will continue to be held in solitary confinement where he has been since February 19, 2003, without having any criminal record in Canada or facing any criminal charges;
During any future detention reviews, in order that Mr. Zundel can be released on bail pending the completion of his Security Certificate Review, the designated review judge must find that it is appropriate to do so under s. 83 of the Act;
The interests of justice require that the appellant be allowed to fully exercise his statutory right of appeal;
Sections 77(1), 78(c), (i), 80(1), 81 and 83 of the Act;

WRITTEN SUBMISSIONS

This is a motion for an order staying the security certificate review herein currently underway before the Honourable Mr. Justice Blais pending the appeal of the dismissal of the Appellant's motion for recusal of Justice Blais due to a reasonable apprehension of bias.
Section 44 of the Federal Court Act stipulates that this Honourable Court has the authority to grant an injunction, of which a stay of proceedings is one type, as follows:

In addition to any other relief that the Federal Court of Appeal...may grant or award, a mandamus, an injunction...may be granted...in all cases in which it appears to the court to be just or convenient to do so. The order may be made either unconditionally or on any terms and conditions that the court considers just.

Section 50(1)(b) of the Federal Court Act specifically authorizes this Honourable Court to grant a stay of proceedings, as follows:

The Federal Court of Appeal...may, in its discretion, stay proceedings in any cause or matter...where for any other reason it is in the interest of justice that the proceedings be stayed.

The three-part test to be applied in determining whether a stay should be granted was set out by the Supreme Court of Canada in Manitoba v. Metropolitan Stores, as follows:

(1) Merits of case - where constitutional challenge is pending, it is sufficient that the case raises a serious question as opposed to a serious or vexatious claim. In all other cases, a prima facie case may be required. (Para. 31-33) (2) Irreparable harm - whether the litigant who seeks the stay would, unless it is granted, suffer harm not susceptible or difficult to be compensated in damages. (Para. 34) (3) Balance of convenience - where constitutional challenge is pending, public interest is taken into consideration and weighted together with the interest of private litigants. In all other cases, determination is made of which of the two parties will suffer the greater harm from the granting or the refusal of a stay. (para. 35, 54, 57, 79, 83)

Serious Question

For judicial improprieties up to August 4, 2004, when the motion for recusal was brought, which give rise to a serious question of a reasonable apprehension of bias, Zundel relies upon his written submission on his Motion for Recusal at tab 5-C herein.
After the motion record for recusal was delivered, there was more concern of new judicial conduct which leads to a reasonable apprehension of bias, mainly on three fronts:

(1) treatment of Zundel witness Doug Christie lacked balance; (2) treatment of former CSIS agent John Farrell lacked balance; and (3) adversarial approach to Zundel counsel.

Regarding Mr. Doug Christie, the concerns were raised by way of Reply in the Motion for Recusal. Justice Blais refused to consider the Reply on the basis that it occurred past the date of the Motion Record. Said Reply has been included under tab 7 herein.
Regarding Mr. Farrell, he was named as the source of a non-fiction titled Covert Entry in which it was intimated that while CSIS monitored Zundel's mail, it may have knowingly allowed through a package which turned out to contain a powerful pipe bomb.

After about six (6) months of efforts and despite Mr. Farrell's resistance, Zundel counsel subpoenaed him to testify at the certificate review herein.

Although Justice Blais had said repeatedly how concerned he was about the bomb which was sent to Mr. Zundel, he disallowed all questions that Zundel counsel asked of Mr. Farrell regarding CSIS credibility, competence and its treatment of its perceived adversaries, even though the entire Covert Entry dealt largely with the lack of credibility and competence of CSIS, described through what it called the story of Mr. Farrell. His Lordship disallowed all such investigation on the repeated basis that CSIS is not on trial. It is respectfully submitted that CSIS's evidence against Zundel is on trial and therefore CSIS credibility, especially with respect to the secret evidence and its competence and integrity must also necessarily be considered.

His Lordship also disallowed Zundel counsel's request to cross-examine Mr. Farrell on a prior inconsistent statement on the issue of the bomb.
During Mr. Farrell's testimony, at one point Justice Blais accused Zundel counsel, who was struggling with His Lordship's many obstructions to his questioning, of goading His Lordship. It is respectfully submitted that it was His Lordship's conduct during Mr. Farrell's testimony which laid bare the concern that His Lordship's manifest conduct had become more consistent with that of an adversary against Mr. Zundel than an impartial trier of the truth.
It is respectfully submitted that the hearing has become so poisoned that, until this Honourable Court provides clear guidance as to whether the described judicial conduct is appropriate and how counsel should reconcile it with the existing law, it brings the administration of justice into disrepute to allow this hearing to continue.
Furthermore, Germany, Mr. Zundel's birthplace, has offered to "pick up" Mr. Zundel at short notice and pay for his deportation back to Germany.

Germany has also indicated that, if deported to Germany, Mr. Zundel will likely face lengthy jail term for denying the Holocaust.

Denying the Holocaust is not illegal in Canada.

R. v. Zundel [1992] 2 S.C.R. 731

As the certificate review process determines whether Mr. Zundel will be deported to a country where he will be jailed for actions that are legal in Canada, it infringes Mr. Zundel's s. 7 Charter rights. It could only be done in accordance with the principles of fundamental justice.

Irreparable Harm

Without a presiding judge who conducts himself in an impartial manner, Mr. Zundel is in effect denied his opportunity to be heard regarding his admissibility, contrary to s. 78(i) of the Act, as follows:

78(i) the judge shall provide the permanent resident...with an opportunity to be heard regarding their inadmissibility;

Unless a stay is granted, the security certificate review will proceed without Mr. Zundel being able to participate in any meaningful way in what is apparently a "rigged court".
The resolution of the appeal on recusal is therefore essential to basic fairness and justice of the process as perceived by the public and as stipulated in the Act to be a governing principle of the security certificate review process:

s. 78(c) the judge shall deal with all matters as informally and expeditiously as the circumstances and considerations of fairness and natural justice permit;

This Honourable Court has in the past granted stay of proceedings due to concern as articulated by Justice Letourneau that "if a stay is not granted, it is evident that [the] appeal will be rendered nugatory" (para. 11).

If the security certificate is held to be reasonable, it constitutes a removal order and, according to s. 81 of the Act,

"...may not be appealed against and that is in force without the necessity of holding or continuing an examination or an admissibility hearing and the person named in it may not apply for protection from the Minister of Citizenship and Immigration."

As previously stated, the target state for deportation, Germany, has expressed inordinate enthusiasm for immediate capture of Mr. Zundel. Unless a stay is granted now, whether Mr. Zundel gets a chance to apply for a stay may depend on whether, should the security certificate be upheld, Mr. Zundel's counsel happen to be in his office when the decision comes through his fax machine.
In Suresh v. Canada, where the individual had been declared by the Minister of Citizenship and Immigration to be a danger in Canada, this Honourable Court granted a stay and held that the individual would suffer irreparable harm if he were to be deported prior to the hearing in question as it would be rendered moot for all intents and purposes.

To deny a stay of the security certificate review process until the recusal appeal has been determined will infringe fundamental principles of fairness and allow the Charter violation as well as other breaches of procedural fairness to occur to the individual's significant detriment and without remedy.

Balance of Convenience

Mr. Zundel has been ordered by the designated judge on January 21, 2004 to remain in custody. Therefore, should a stay be granted, Mr. Zundel will continue to be held in solitary confinement where he has been since February 19, 2003, without causing any danger to the security of Canada.

In the case of permanent residents, in order that such person can be released on bail pending the completion of his security certificate review, the designated review judge must find that it is appropriate to do so under s. 83 of the Act.

In Romans v. Canada, it was held by Mr. Justice Evans of this Honourable Court that concern for public safety can be addressed, in appropriate circumstances, by detention. It is respectfully submitted that such is the case here.

It was held by this Honourable Court in Suresh v. Canada that the balance of convenience favours the individual to the extent that the individual has already lived in Canada for an extended period of time. It is not disputed that Mr. Zundel had previously lived in Canada for more than 40 years and has no criminal record and no outstanding criminal charges in Canada.

Unless a stay is granted, should the appeal from the recusal motion be granted, Mr. Zundel will in all likelihood be in a German jail and unable to receive any meaningful remedy, a situation which, in the view of Justice Letourneau in Said v. Canada, should be taken into account in determining the question of balance of convenience. Justice Blanchard came to similar conclusion and granted a stay in the recent case of Almrei v. Canada.

As stated by Justice Pinard in Kindler v. Canada, the interest of justice therefore requires that the appellant be allowed to fully exercise his statutory right of appeal.

EDMONTON, February 5: TWO DOZEN free speech supporters braved frigid cold to protest outside Deputy Prime Minister Anne McLellan's constituency office in downtown Edmonton today and bring her their demands that she intervene and free Canada's most famous political prisoner, Holocaust skeptic and publisher Ernst Zundel.

McLellan is the minister responsible for border security. Paul Fromm, the Director of the Canadian Association for Free Expression and the spokesman for the protest, said "Ernst Zundel has been in solitary confinement in the West Toronto Detention Centre for almost two years. He's being warehoused. He hasn't been charged or convicted of any crime. His ongoing imprisonment in inhuman conditions, with the dregs of society is a disgrace."

Ernst Zundel was a landed immigrant in Canada since 1958. He moved to the U.S. to live with his wife Ingrid Rimland, an American citizen in 2000. He was kidnapped by American authorities, his wife insists, and summarily deported for at worst a minor technical violation. Today is the second anniversary of this deportation. Mr. Zundel, a publisher of numerous works questioning the Hollywood version of World War II immortalized in such fictional works as Schindler's List, was a highly successful graphic artist in Canada. He was deported to Canada and promptly arrested as a "threat to national security."

"Ernst Zundel has been an open book in Canada. He is a pacifist. Yet, the Canadian government, reacting to powerful minority interests, insist Mr. Zundel is a terrorist. This is utterly bogus," Paul Fromm told the protesters gathered around a huge Red Ensign [Canada's traditional flag, pictured above]. "If the authorities had proof of any such actions, they should have charged him. He's in prison for having his own take on history and trying to rescue the German people from a 60-year campaign of hate and defamation."

"The Zundel hearings are a blot on Canada's reputation. They rely on days of secret testimony. Mr. Zundel cannot learn the nature of the charges against him and, thus, cannot mount a real defence, " Fromm charged.

Paul Fromm, director of the Canadian Association for Free Expression, led a group of about a dozen people in a rally outside Deputy Prime Minister Anne McLellan's Edmonton constituency office Saturday to mark the anniversary of Zundel's detention in a Toronto jail.

Fromm said Zundel is a political prisoner, and that Canadians should care what's happening to him even if they don't agree with his views on the Holocaust.

"They say he's a terrorist. He's obviously not a terrorist. His crime is that he has his own particular take on history,'' Fromm said.

Zundel is facing deportation to Germany under a rarely used certificate that describes him as a danger to Canadian security.

He lived in Canada for 42 years but was jailed in 2003 when he was deported by U.S. authorities for alleged immigration violations.

McLellan, whose responsibilities include border security, was not in the office during the rally.

Demonstrators were reluctant to share their own views on the Holocaust, saying they were at the rally because they supported free speech.

"My personal views aren't really in question here,'' said Alasdair Rintoul. "If it can happen to him, it can happen to anybody."

Supporters of Holocaust-denier Zundel protest outside LA Canadian consulate

LOS ANGELES (AP) - Supporters of German Holocaust-denier Ernst Zundel protested Friday outside the Canadian consulate, demanding his release from a Toronto jail.

Sponsored by an organization called the Institute for Historical Review, demonstrators held signs with Zundel's picture and others that read Shame on Canada. Flanked by Zundel's wife, organization director Mark Weber handed over a letter to a consulate representative, asking for his release.

"The case is an outrage," Weber said.

"He is being held on the pretext of being a threat to national security."

Zundel, who has been in a Toronto jail facing deportation to Germany, lived in Pigeon Forge, Tenn., until he was deported back to Canada in 2003 for alleged immigration violations. He remains in custody while the deportation case against him continues.

Zundel, 65, faces prosecution in Germany for his neo-Nazi and Holocaust-denying activities. Since the late 1970s he has operated Samisdat Publishing, one of the leading distributors of Nazi propaganda and since 1995 been a key content-provider for a website dedicated to Holocaust denial, the Anti-Defamation League has said.

During the protest, Zundel's supporters were met by about 40 backers of the Jewish Defense League. Waving Israeli flags and chanting "God bless Canada," both sides shouted at one another on issues including free speech, the Middle East conflict and the Holocaust.

There were no immediate reports of any arrests, police said. ...

Wendy Campbell, who stood with about two-dozen Zundel supporters, said those who came out to protest were from different walks of life who feel Zundel has been given a raw deal.

"It's a matter of trumped-up charges," Campbell said.

"He's simply a political prisoner who is in jail for speaking his mind."

Zundel has challenged the constitutional validity of the security certificate review process under which he is charged. The government filed court papers last year saying Zundel was a threat to engage in terrorism or other violence and should be deported.

The Canadian security certificate law, passed after the Sept. 11, 2001, attacks in the United States, allows the government to hold terrorism suspects based on secret information.

Born in Germany in 1939, Zundel emigrated to Canada in 1958 and lived in Toronto and Montreal until 2001. Canadian officials rejected his attempts to obtain Canadian citizenship in 1966 and 1994.
