Man Gets Prison Time For Killing Robbery Suspect 62-Year-Old Expected To Appeal
INDIANAPOLIS-- An Indianapolis man was sentenced to six years in prison and two years of home detention Thursday for fatally shooting a person who allegedly robbed him.
Police said Michael Clements, 62, shot Leon Williams in December outside Clements' house in the 2800 block of North Boulevard Place. Clements (pictured, left) told authorities that Williams had entered his house, threatened him with scissors, and then robbed him of $27.

Michael Clements is in danger of the black community finishing what the black crook didn't finish -- the theft. Clements is likely to find himself on the receiving and losing end of a wrongful death lawsuit and a civil rights violation lawsuit which will put him in debt for the rest of his life. When there are protests in the street, in won't by good people objecting to locking up a guy for defending his property, it will be blacks lifting a criminal to martyr status and demanding Clements be kept in jail.
Although, shooting someone in the back is a mistake. Honestly, though, I would have still shot. The criminal violated my home, threatened my safety, and is leaving with my property. Even if he dropped my property, he'd have no right to leave and I'd feel right in using force to detain him until police showed up. Shooting a criminal is a service to the community. Clements should just have gotten the guy to turn around before shooting.
A man shouldn't have to go to jail just because he didn't a criminal to turn around.

My friends on the Sheriff's dept. have told me to make sure you blast the perp inside the house, if you can. If not, and no one is around, drag him inside. Unless your local police force is infected with detectives that march the PC line, most will see the incident for what it is, if you know what I (they) mean. Lastly, if he doesn't have a weapon, make sure the perp does have one by the time the cops arrive.

I have to agree with your sentiments here. While Clements shouldnt have shot him the way he did, I can certainly understand why. Too bad he didnt kill him, but then again, hed have murder charge against him. Clements actually did society a favorite and if I were to find myself on a jury with something like this, Id go for jury nullification. I had someone steal a bunch of my tools one time and if I had caught him I think I would have tried to kill him for violating my property and livelyhood.

I stand corrected. I was thinking of the aggrevated battery charge when I wrote that. Seeing how I was mistaken let me re-phrase that. Good for Mr. Clements. That is one less violent criminal. I wish Clements the best in the future.

Each state has different laws. Here in NC I believe you are somewhat limited in exercising your right to self-defense. You can shoot a criminal as he is breaking into your house, but once he is inside I believe the law is against you shooting the criminal.
The bottom line is that in order to be convicted you first have to be charged, then found guilty by a jury. Neither the law, nor the jury served justice in this case.

Unfortunately, you can't have "jury nullification" in civil cases because the judge can enter a directed verdict on the theory the jury's decision was contrary to the law and evidence. This poor hmeowner is almost certain to get cleaned out. Unlike Orental James Simpson, most of his modest estate won't be beyong the reach of creditors. Concerned Whites might be able to start a "spendthrift trust" for this man which would be beyond the reach of his creditors. Depends on Indiana law.
Blacks rally around their own. The O. J. Simpson case was lost when black "leaders" coaxed the politicos into moving the trial from its proper venue in Brentwood to a venue where a majority mud jury was a foregone conclusion. This poor man probably lived in a changed neighborhood as his younger and more affluent neighbors had long ago flown to Whiter pastures. If the case had been moved to a court out there the homeowner might have gotten a much lighter sentence.

I feel for the poor guy, but let his 'peeps' bail a brotha out.

The shooter is a black guy. The first clue is that race isn't mentioned in the article (when has a white man ever shot a black man and the media failed to point out that the shooter is white?). Watching the video and it is clear that he's a black guy who has had "run ins with the law in the '60s and '70s."
When you shoot a criminal, always shoot to kill. If the criminal isn't dead, you will be made to regret not killing him. And, be very careful if you need to move the body. How will you explain to the cops why the criminal's blood is on the ground 20 feet in front of your house? Anyway, take your time calling the police. If the police don't show up in a timely manner then you can more safely guess that there were no witnesses (no one called the cops) plus waiting a bit to call the police will give you time to calm down and get your story straight (hint, say as little as possible even when the police do show up).
Also, when the cops do show up, they will want to search your home. They might tell you that they just want to take pictures of the crime scene but if they see something that isn't politically correct, you will be arrested. Also, the police are likely to be incompetent clods so if there's any evidence you want them to see, make sure the evidence is either in the open or that you point it out to them. For example, if the guy ditched a stocking mask on the way out of your house, the cops won't find in behind the bushes or whereever he tossed it so make sure you find it before the cops show up so that you can tell the cops that he wore a stocking mask and where he threw it.

I think everybody should know that, and I thought most people did, but unfortunately its not listed in most home maintenance books.
It helps for him to have a gun, but its not really necessary. Just mentioning that
you saw a bulge in his pocket, and that it looked like it could have been a gun, and that
That you saw criminal going for alleged gun
The fellow made threatening statements and was moving to attack you
You repeatedly warned him to desist and leave, but he just got more angry and threatening
etc, etc.
Anyone who's ever listened to police acounts of shooting should have detected this standard procedure . It should be called "how to kill somebody - the legal (police) way".
