TORONTO -- A London white supremacist convinced a Canadian Human Rights tribunal yesterday to give him more time to find a lawyer, although he's had almost two years already.
Sombre-faced tribunal chairperson Karen Jensen agreed to a request from Tomasz Winnicki for a delay of at least five days.
"Suffice it to say we are not in a win-win situation," Jensen said.
She reminded Winnicki he had already had plenty of time to get a lawyer and had been advised months ago to do so.
But, she added, an adjournment was the only way to ensure he got a fair chance at a complex tribunal hearing.
"To proceed now would not be in the best interests of justice," she concluded.
The spectre of more legal battles arose yesterday when the lawyer who lodged the complaint, Richard Warman, notified the hearing he and the Canadian Human Rights Commission would be objecting to each of the four witnesses Winnicki was planning to call.
Winnicki, London's self-avowed "biggest hater," plans to call white supremacists Jason Ouwendyk and Melissa Guille of London, Brad Love -- convicted in 2003 of promoting hate -- and Paul Fromm, head of the Canadian Association for Free Expression.
Tribunal documents show Winnicki plans to prove his messages on the Internet are justified and the Canadian Human Rights Commission is biased against whites.
[B]The commission is taking Winnicki to the tribunal over dozens of Internet messages he has posted, mainly on a neo-Nazi forum called Vanguard News Network. [/B]
The commission alleges the messages contravene the Canadian Human Rights Act, which prohibits Internet messages likely to expose people to hatred or contempt based on skin colour, religion, or sexual orientation.
[B] The profanity-filled messages attack non-whites and non-Christians and call for a separate white society, even if it takes a racial holy war.[/B]
The case was launched in September 2003 when Warman filed a complaint with the commission.
Winnicki was told about the complaint in October 2003, commission lawyer Monette Maillett said in opposing the adjournment.
The legal documents making up the bulk of the case were given to Winnicki in February, Maillett said.
Asking for adjournment now, after the commission has already examined its only witness, "is completely unreasonable," Maillett said.
But a lawyer hired by Winnicki for one day, just to press for an adjournment, said [B]his client was surprised by the complexity of the case when it was presented [/B]Monday, the first day of the hearing .
"He needs counsel to fully represent himself," said Alexander Beadie.
Some of the web messages used in the commission's case were only handed over in July, Beadie added.
Those later messages were submitted only to show that Winnicki continued to post objectionable material despite the looming hearing, Maillett countered. Besides, she said, he posted it himself, so it shouldn't hold any surprises.

That's why anyone who has views like ours but wants to stay out of the government rape rooms NEEDS to arm himself to the teeth: armor-piercing rifle, gas mask, heavy (NIJ Class III or above) body armor. And stay in top physical shape! Even if you have to die resisting, that's better than going willingly into a living hell, being raped and tortured.
If freedom dies completely in America, it dies everywhere. We cannot let the Jews win. We can't give those smirking bastards the satisfaction. Please, people: ignore the a--holes who tell you you're "playing Rambo" and prepare. There's an awful lot that a few smart and motivated people can do to strike back at would-be tyrants, should it come to that.
