I'll give you a scoop that will probably come out after the election. Rehnquist has extremely aggressive cancer and has six months to live. I knew this information late Friday afternoon and knew the preliminary news would come out Monday. It is strange to know this and watch all the major news programs speculate about his condition and a possible recovery and return to the bench.

Justice Rehnquist is a devout Lutheran, and given his work and record over the past 30 years on the highest court he has been very pleasing to God. No doubt he will reach the highest level in Heaven.

The very idea that a couple of non-entities like Bush or Kerry is going to pick the next Chief Justice of the Supreme Court is utterly depressing. However, if Bush does win, I'm sure his pick would be a lot better, so Justice Rehnquist's apparent demise will provide some measure of a silver lining of sorts for the dark cloud of a potenetial Bush victory.

Here's a scary thought: Chief Justice of the United States William Jefferson Clinton. Why not? There's already a precedent for a former President holding that office, i.e. William Howard Taft....

I tend to agree that the next Chief Justice will be a currently serving Associate Justice, but I wouldn't rule out the possibility of Clarence Thomas (although if the Democrats retake the Senate, then Scalia would definitely be the one, as Bush would not want a repeat of Thomas' 1991 confirmation hearings). Ginsberg would tend to be Kerry's choice, although he might prefer Dreyer/Breyer (I can never rememer which it is), who I think is younger (Ginsberg is about 70).
