RICHMOND, Oct. 23 -- A Richmond accountant who helped his daughter get a $507,490 tax refund for nonexistent "federal slavery tax credits" was sentenced Thursday to 13 years in prison. His daughter was sentenced to three years.

The case was being closely watched by advocates of reparations for black Americans whose ancestors were slaves. But Thursday's hearing in a packed U.S. District courtroom was equal parts tax protest and ugly family drama.

Crystal Foster, 25, wailed hysterically after her sentencing and fell to the floor before about two dozen friends and relatives, leaving many of them sobbing and begging the bailiff to open the courtroom doors so they wouldn't have to watch federal marshals drag her away.

Foster, a mother of two young boys, and her father, Robert Foster, 51, were convicted in July of filing false tax documents and conspiring to defraud the government. According to trial testimony, Crystal Foster used the Internal Revenue Service check to pay off student loans and buy a $40,000 Mercedes-Benz, among other things.

The check, which she received in October 2001, is believed to be the largest slavery claim ever paid by the agency. [B]IRS spokeswoman Michelle Lamishaw said yesterday that the IRS received nearly 80,000 tax returns claiming $2.7 billion in nonexistent slavery credits in 2001 alone[/B]. [COLOR=Blue][B]It has paid out about $30 million in fraudulent reparations claims, she said, but she was unable to say over what time period. [/B] [/COLOR]

Previous prosecutions have focused on tax preparers and firms that recruited blacks to file false claims and charged them fees to prepare the returns.

Prosecutors have noted that Crystal Foster's fraudulent return did not specifically mention reparations. Instead, it used an IRS form for reporting previous tax overpayments, claiming that she had paid too much tax on capital gains from the fictional Black Capital Investments fund.

[B]IRS officials say many fraudulent returns are spotted because they claim an overpayment of $43,209 -- the amount suggested in a 1993 Essence magazine article as the value of the mule and 40 acres some freed slaves were given. [/B] Crystal Foster's lawyer, David Lassiter, noted that many blacks believe that such a tax credit exists.

"Blue-collar, white-collar, people from all walks of life," he said.

Demands for reparations began before the Civil War ended, but the movement has gathered steam only in the last decade. Last year, blacks filed lawsuits against several large corporations, accusing them of benefiting from the slave trade.

Many of the courtroom spectators came to champion reparations and assert that blacks are not subject to U.S. laws because they were brought to the country as slaves. But Lassiter told Judge Richard L. Williams that Crystal Foster was a victim of an abusive father and "the hold he has on her," adding that her father prepared the tax return and that she had no criminal intent.

Relatives and friends said they supported both Fosters, who sometimes sat at the same table in the courtroom -- she in a skirt and sweater, [B]he in black-and-white striped pajama-like outfit.[/B] [COLOR=Blue][B]Supporters said the pair was victimized twice, once by the legacy of slavery and again by the judicial system. [/B] [/COLOR]

[COLOR=Blue][B]"It was unjust because we are supposed to get reparations as black people -- just like the Jews got it. What do we get? Jail time[/B][/COLOR]," said family friend Margaret Roach, adding that she pays taxes but believes in claiming reparations through the tax system. "We get it any way we can because we are not treated fairly."

Over the summer, Robert Foster tried to dismiss his attorney, Thomas Johnson, and hire a Charlotte-based reparations advocacy group, but Judge Williams wouldn't allow it. Before being sentenced yesterday, Foster told the judge that his name is Nastaffa Nahm-El and that he wanted some time to get "competent counsel." [B]He also said he was speaking for "Robert Foster, copyright". Foster has said his name is copyrighted and has threatened to sue anyone who uses it. [/B]

Johnson tried to counterbalance his client's rebellious image, noting that Foster is an Army veteran and worked as an accountant for the federal government in Richmond's veterans hospital.

Williams imposed terms on the more lenient end of the sentencing guidelines. In addition to filing his daughter's false return, Robert Foster was convicted of filing false returns for himself and two clients. Attorneys for both father and daughter said they would appeal.

This is just another reason why Constitutional Democracy is so great.

I can't believe that any of these bogus slavery reparation refunds are getting through without complicity on the part of IRS employees.

Not just anyone... these are POOR, VICTIMIZED NEGROES. :wallbash:

But I agree, there had to be some sort of inside help. Sure, fedgov is incompetent, but I can't believe this many got away with this much B.S.
